Though he went out of his way to put me down in both feedback and emails, in the course of which he violated TradeMe's own terms and conditions, he's also not read Microsoft's EULA*, (quote: "Microsoft's EULA" what the hell is that??) in which it states clearly that what this trader was doing was breaching it. AFAIK, the OEM XP Home CD was not pirated, but having already been used, it should not have been sold the way it was in the first place. PS - I heard Microsoft are currently in discussions with TradeMe regarding sale of MS OEM software. * End User Licencing Agreement |

Thing is, I try to treat people well and expect the same from them . 99% of the time it all works out ok but occasionally some sharpie, opportunist or predator climbs out of the woodwork and spoils the fun . Ah well, that's life eh? |

| 378661 | 2005-08-08 00:10:00 | Thanks bob_doe_nz. As I said before, AFAIK, the supplied CD was not pirated, but the sale of it was/is in breach of MS's EULA. Different thing, and because of this I don't think MS will give me a nice shiny new XP Home :( |

| 378663 | 2005-08-08 02:09:00 | I had a look at the ad. He says its an OEM copy of windows blah blah, (& a small part of the computer). Leaving aside the issue of it being previously used: The item was bought using buy now. Seller claims to be a "wanna-be computer nerd". I think he has mentioned the hardware cause he nows damn well he should only be selling a new OEM windows with the required hardware (which doesn't have to be the whole system, but does need to be more than a screw). His feedback reaction was petty and spiteful and he knows he is in the wrong. However - - the purchaser should also know you can't buy an OEM copy with out some (proper) hardware so why do buy now? I think some fault there too really. |
