pretty much got screwed, i think its sad that you would hafta go through a court to get anything done about it quite honestly, as bartsdadhomer said, get everything you got on him and crash his party muahahahaha

378646 2005-08-05 08:54:00 I got an OEM XP Home 2002 with my first computer, and I've been using it ever since (it's soon to go on my third rebuild/upgrade). It does not seem to be locked to any particular hardware either, so I don't have any problem with that. Nor does microsoft - I must have re-activated with that Key tons of times... Agent_24 (57)

In my experience, these type of people are apt to disappear at the first hint of trouble. Let the first they are aware of anything amiss in their low existence be when the bailiff snags his computer for eviednce in a civil case.

Don't do anything dodgy youself in pursuit of info like compromising a bank employee and the evidence gathered in such a way. (who'd loss their job and possibly face prosecution, if found out). Just give them as much as you have, including auction number, email addy, etc.

As stated above, MS are compensating snou...... upright law abiding citizens who help them catch prirates with replacement copies of XP.

BTW, I take it the screw was supposed to be the hardware that qualified it as an OEM sale and not an, in your face up yours schmuck, indication of what he'd just done to you :xmouth:

378648 2005-08-05 09:18:00 I recently bought an OEM copy of XP Home on TradeMe for $100. There was no mention on the 1-day auction page that it was not new. When it arrived, the CD was scratched on the data side. The XP version was 2002. A small PC case screw was taped to the CD jewel case and the thing had obviously been used and authorized to match a different mobo/hardware system than mine.

Ah - the screw is there to cover the sold with hardware requirement.
So he was ok to sell it. However not if it had been used.

Actually NO, the screw doesn't cover "hardware"

Microsoft's own definition of harware that goes with OEM software is any component that has to be connected the motherboard, although the screw attaches the motherboard it is not a functional hardware component that makes or facilitates computing on your PC .

So even there the seller is a dim wit . . .

As for the original poster . . . I agree,, gather as much information as possible and then contact MS . . don't let the seller know you're on to him .

The other thing you could try doing is see if MS will give you another license key . . . probably a shot in the dark but hey you never know . . . if the disk is an original and is working then maybe they'll give you a new key .

378651 2005-08-05 11:13:00 oh yea if i recall correctly each cd will only work with its original serial, you can change the serial(for example if you buy one of Microsoft, or if that sleezey cheap "lovely person" sends you one) within windows when you go to activate it Codex (3761)

Quite the opposite, it may not be of much help to you now that you have been caught in a dud deal but you will probably wont do it again, so I stand by my comment "you must be completly insain to buy a MS OS from TradeMe".

As for you taking offence to that, I guess that’s just bad luck, not your week I suppose.
