1382149 2014-08-20 03:30:00 My suggestion would be to work closely with your Lawyer. ;)

He won’t thank you if you derail him by doing something that gives them an out.

Are they members of the Master Builders Association? If they are then the MBA may be able to help.

Good luck. :)

BUT don't depend on the Master Builders Association -- Seen Fairgo lately ?
There's been several times over the last couple of months (Cases on Fairgo) where people have had building problems and MBA don't want to know about it, they wash their hands of it and have actually backed the Builders, not the home owner.

1382151 2014-08-20 04:14:00 Thxs guys. Appreciate the feedback...been in touch with Campbell's team...lets see what they say...as for the master builder, they are as f'd up as the builder...doesn't give a toss...

the only down side from my end is that...I beat the **** out the builder as he came to my place and threatened my wife (kids were there as well) while I was out..i was thrown in the cell for a nite and case is with the court...but by god....its felt so good and I slept like a baby in the cell while he was on the hospital bed for few days :)

I haven’t seen Fair Go but it seems nothing has changed with the MBA over the years.

Yes, when I’ve had dealings with them they backed the builder all the way too, but in the end they found, much to their horror, that their 10 year written guarantee was enforceable. ;)

You’ll find the Law Society and the Real Estate Institute also only act to protect their errant members, so when dealing with any of these organisations you need to get your ducks in line before you start. ;)

Perhaps a complaint to the Minister of Justice about these Professionals behaving unprofessionally may get some action? :tui: Oh, yeah, nah. She would get them put onto the New Year Honours list. :yuck:

1382155 2014-08-20 06:31:00 Thxs Dugimodo..correct me if you think I am wrong. Once I have bought a product, I own it and I can say whatever I want about it or cant? Presume the same goes for the service as well?

What I wanted to review and upload was about a house. we got a house built, paid premium price and 5 months later, cracks in the wall, water leakage, drive away cracking up and other issues and the company that had built it had just washed their hands off it and not responding. I have all these on vid with dates, etc...my lawyer is looking into it. but once I started doing my research into the company online (which I should have done prior to choosing them) and I found out that others have had similar issues with this company. they are quite a known company and I wanted to share my side of the story so that others are aware of it and if possible don't end up in our situation. once I have uploaded the video, I plan to send the link to that company as well so that they can explain as well if they choose...fair playing ground...

Obviously there is more to the full story than you can go into here, but when you mention cracks in the wall, leaks and driveway cracking, this all leads me (as a builder) to start thinking about ground movement for some reason. Whether it be the water table, or earthquakes or something else.
I say this, because they are all different materials, so you can't blame poor material use (probably). Concrete in particular is pretty durable if it is laid even semi-accurately. For that to crack you would have to either not do the control joints, or have them cover too large an area.
Of course there is the chance the ground was not compacted properly first, then this would definitely fall back on the person doing the work. However the Building inspector should have picked up on this anyway.

So if it were me, I would be ensuring it wasn't anything like that ( water table, or earthquakes etc) before even risking a defamatory case by uploading a bad review, where you need to be very careful with your choice of words, as has been well explained.

1382156 2014-08-20 06:49:00 This answer / Point relates to software, but it can also apply to other items :

correct me if you think I am wrong. Once I have bought a product, I own it and I can say whatever I want about it or cant? No - For example take Windows or any other MS product -- When you buy it you are only buying a licence to use it. Microsoft STILL own it.

Going back to the house -- As its pointed out above, there seems to be some other reason for the faults.
