My ISP was and still is Telstra. I was on their 256k/256k plan with a 10gb datacap with excess usage being charged at 2c per MB; $90 a month. I have been with Telstra since mid 2002 and except for a speed boost from 128k/128k and a price reduction of $10 our service hadnt changed.
The problem that occured with the usage meter was that our usage wasnt being recorded (we had already used 7GB that month), Telstras solution to teh problem, so that we didnt go over and get charged lots of money (something we would not be able to prevent) was to move us to on of their more current plans; 2mbit/256k; 10gig cap; excess being charged at $4.95 per 500MB block; $71 per month; Effective immediatly.
Everything was fine, we had 10gig to last us from november 27 to december 5(our datacap resets on the 5th).
Life was great.
Early this year, January 15th to be exact, my usage meter 'broke' again.
In mid feb i got bumped to 2mbit/2mbit, $4.95 per gig.
Over the past 6 months ive grown to depend on my internet connection, at times using several hundred gig a month.

Just incase my datacap came back i made a point of checking on the 5th of each month.
Everytime ive checked the usage meter still only displayed up to Jan16.
About 2 months ago the login showed an error
"There are no highspeed services assoiated with this account"
and 1 month ago the same error resulted in me trying to login.
I havent been charged any extra money because of this.

As you can tell i lost all self control i had learnt over the past 4 years.

On July 13 my internet connection stopped working.
So as to not attract undue attention to ourselves we waited a day and hoped it would correct itself.
It didnt.
When we called tech support we were told to change our ipaddress, default gateway and DNS servers to different values than we had been using (we werent informed in advance that they were to be changed).
Our connection was back up and running after the phonecall.
We thought nothing else of this event.

Roughly a 10days ago a friend of mine from school who shares the same plan as i do informed me that everyone on telstras 10GB and 20GB 2mbit plans were getting bumped to 4mbit. this was very unexpected.
On the 5th (the day i expected my 4mbit to be activated) i checked my usage meter at 1am. What I found was anything but pleasent.

Honestly im screwed.
My father plans on talking his way out of paying for the excess due to the fact that we havent been able to check. "Anyone would have assumed that not having a datacap was part of the service after 6 months"

Somehow i am now on the next plan up, the 20gig plan, 2.95 per gig.
Supposedly still $71 a month.

Unless my datacap 'breaks' again next month i dont know how im going to manage.

Which brings me to my question.
"How the hell am i supposed to use 4mbit with only a 20gig cap?"
How is anyone supposed to?

If you can’t control your downloads then you should either go down to a slower speed if you can or see if your ISP can slow you down once you hit your bandwidth cap.

It is quite easy wth high speed plans. I am on the Ihug 40+40 and often use the 40 on-peak and about 10 of the off-peak each month.
Those american TV shows come through at high rates of knots and as they dont get to our sunny shores for years it is the only way to watch them.

None of Telstra's plans have slowdown when you go over your cap, even if they did it would be horrible.

As did I 2 years ago. Over time however as one is exposed to more and more of what the internet offers one uses more. What one takes one must give back.

Prison break and HouseMD are good examples along with countless anime series.
I dont watch many movies and music doesnt consume much space(i have about 40gig of which ive ripped 30gig).

I figure i could easily get my usage to 50gig a month. Getting it to less however would be exceeding dificult the lower i go.

In most countries do they not have unmetered connections?

The reason why Tcl are unlikley to be sympathetic is because your usage (afaik) actually cost THEM about $480+ (assuming $2/gb). If you've been doing that every month, you might be lucky not to have been taken to court for the $400 a month they've been LOSING off you, which over six months is a grand $2400 (the actual charge at overage rate is about $7k...).

Of course, I can see where you're coming from and there's a good chance that you won't need to pay. I wouldn't expect them to be very nice about it though, because it's not like when you take three new releases back three days late, and get whacked with $45. That causes no actual losses to the shop, so they might be willing to forget about it, but if Tcl waived this it would take 5+ years to break even with you.

Also, I recommend you move to the $139.95 plan of 80GB/10mb, although that might do more harm than good given the way your usage seems to react to speed increases. You might be able to negotiate speed capping with them, which might be a better idea.

So ... you have a leg to stand on but it might have to go through the Disputes Tribunal.

Looks like you have been getting heavily leeched from, I am guessing you have been using a crappy public torrent site.

Utorrent has the ability to limit speed up and down failing that you could use netlimiter (I use both, extra security if I screw up).

I have a 10M/2MB 40 gig connection and can stay inside my data cap no problem and I am a fairly heavy torrent user.

You may be able to negociate a partial over usage charge, I doubt you can get out of it completely.

476482 2006-08-07 01:24:00 The reason for the high uploads was that after the first 2 months i figured that if it wasnt costing me any extra, i should atleast give something back to the community. So i ended up running utorrent 24/7 capped at 200KB/200KB.
Last night i downloaded the latest 2 episodes of the avatar (released on july14...) and i was downloading at abuot 100KB/s uploads capped at 50KB/s.
I capped them at 25KB/s and i didnt notice any change in speed.
When i capped them to 5KB/s my downloads dropped right to 20KB/s.
I do however feel that over the past 6 months i have seeded enough to last most people a lifetime.
When unmetered connections become avalible for cable in newzealand i will resume seeding as a hobby.

I am trying to convince my dad to switch to that plan. I assume you are also with telstra, as far as i know noone else in newzealand offers anything that fast
