Im confused.

In the past,if I had wanted to cut down an even non native pine tree, the council would make it very hard for me.
If i wanted to cut down, say a Kauri (dont have) or pohutukawa(do have) I'm sure the council would prevent it
Ak residents have in the past been stopped from cutting down trees that could be a real danger to home & life, large trees 10 feet away from a homes with
large branches overhanging homes .

So developers are allowed to cut down trees but residents cant ?
I know Ak council have made this whole issue as murky as possible, for the av home owner.

Without getting into IF the tree should be felled, it again seems like 2 sets of rules.

Of course.
They get heaps of money from developers: consents, new connections etc.....

And:
"Development contributions are the fees charged by the council for extra community and network infrastructure needed as a result of development projects.

You will usually have to pay development contributions for residential development such as new houses and apartments, non-residential development, subdivisions, and for some changes of land use."

See?

Anyway, waste of time sitting in the tree, it's not his, not his property, done deal, so all he's doing is causing himself a trespass fine.

1396066 2015-03-09 23:35:00 The tree hugers forget about property rights. You own the property and the trees. You should be able to cut them down if you want without some ponc from the council / Gov / Maori tribe being able to stop you. The council gave the developer a consent to cut it down and if they try to revoke it they end up in the high court and will have a judgment against them again..

Then again if you want to cut a branch off a tree you own you have to go thru the expensive process of consents, Arborist..

1396067 2015-03-10 02:06:00 Is it just me that finds it strange that with animals is the young ones we protect the most but with trees it's the elder plants.
I say plant half a dozen Kauri trees somewhere out of the way, don't let anyone cut them down for the next couple of centuries, and go for your life. The planet still gains on the number of Kauri trees and nobody has to waste time protesting over a plant. I like trees, I like forests, but I won't get emotional over cutting one down.

As for trees on my property, mine are fairly small but if they need pruning I prune them and if they get in my way I remove them. At what point does it stop being a shrub/hedge plant and become something you need consent for? I might look it up myself.

1396069 2015-03-10 06:04:00 I'm not a tree hugger and have no real thoughts on this issue apart from.

Kauri are suffering from an unknown disease which is killing them off in Northland so cutting on down without a plan to replant more is pretty dumb in anyone's book. If these two trees are so important why were they not given heritage status years ago which would have prevented this situation developing?

1396070 2015-03-10 08:59:00 Unfortunately the National government changed the law some years ago so that councils were no longer able to have by-laws that would protect trees.

Right now the planet needs as many trees as possible. It's not a time to be cutting them down.
