485268 2006-09-17 03:12:00 When I got my computer, It came with a WINXP home cd...in a box with a Certification Autheticy Label....And I stuck that label on the side of my PC because knowing me the box wouldnt be around for long and dont wana lose the serial...but then I ended up getting WINXP pro....therefor the winxp home is finished...and now I got a unused serial/cd here....tried to sell it on trademe..

Was there for a week...1 day before ending (reserve $50...was up to $98!!)...auction got banned by trademe...not allowed to sell OEMS...but according to the CD it says "ALL microsoft products are licenced to OEMS" so how can trademe determine as they said...if its a OEM must come with computer...???? I even said on the page that its a totally unsed Serial coz i reformatted and use winxp pro with its own serial....I attempted to remove the sticker from side of computer but i cant even get it off....

It came boxed with my computer...I purchased my computer without OS...but they threw in some software and one of them was a OS....And I've had to fix 5-6 computers using this WINXP home cd...but with each individual serial...

Can I reattempt to sell? As I can see trademe has quite a few of these on there? I'm selling because i dont need it, and i know it will be of good use to someone who needs it..

485269 2006-09-17 03:39:00 If trademe have removed the auction you probably won't have much luck....you can try again but if they have to remove it again then you risk loosing your user etc.

but according to microsoft...every microsoft product is a OEM.....

and trademe removed it coz it was OEM and OEM products have to be with a computer at point of sale?

can you see the confusion here?

485271 2006-09-17 04:21:00 I think you're a bit confused between retail and OEM versions.

Software sold as boxed retail full versions can be sold (usually). These are the ones which say in their licence agreement that they can be re-sold, provided its been removed from any PC it was installed on.

OEM versions state in their licence agreement that they can't be sold (or even transferred for that matter). So if you have an OEM version, you can't sell it on its own, you have to sell it with the PC it came with.

So IF your copy of Windows is OEM (which it probably is), then you can't sell it. If it's retail, then you can, and you should advertise it as such.

485272 2006-09-17 06:15:00 Hi, on Trademe's Terms and Conditions - it explains you cannot sell oem copies - because you purchased your computer with the software pre installed it is classed as oem, you may only have the serial number but not the xp home disc - as most sold computers only come with restore cd's - if you were to sell it on TM just put as is - and dont mention oem maulaulau (6699)

Bad advice ... all you are doing here is trying to mislead the seller too. This is why OEM software is cheaper - it has restricted rights. It lives and dies with the hardware, which is why you aren't supposed to remove those stickers...

I've seen on TradeMe where silly people just relist something by selling a cheap unwanted PC component and then saying "free CD" thrown in. :D Still against the rules..

Did it come in a big box with all sorts of stuff packed in it? Saying Retail Version?
Then you can sell it.

Or did it come with the silly little booklet and a sticker and says OEM? Then you can't sell it, regardless whether you used it or not.
