I would say that they can expect a cease and decist notice in the mail from Apple before too long.

548364 2007-05-28 09:57:00 numerous companies have been selling better products cheaper than apple has been, and many of those have stolen the ipod look to make the product "cooler", but apple isn't sueing them, nor microsoft over all the stolen mac features in vista now are they?

did ipod actually patent that design? i don't think that's even possible. if so i think they would've stopped the rip-offs a LONG time ago

"iPod" as you put it, didn't patent any design as "iPod" is a brand name created by the ad agency TBWA Chiat Day for Apple. There are a number of aspects of the iPod that are protected by patents including the click wheel itself. The actual patent relating to the look and aesthetics of the iPod also belongs to Apple. The menu system on the iPod is also patented by Apple- Creative sued Apple successfully to the tune of $100 million US over what they believe was an infringement of their own patent regarding the rights to "prior art" over the alleged copying of the iPod menu system which they claim that they designed first.

A guy buy the name of Tony Faddell who originally had the concept for a small portable media playing device that eventually became the iPod and who is a very talented electronics engineer had the idea while employed at Philips Electronics in Holland. He showed is original concept to a number of companies who all declined his offer until he finally took his idea to Apple HQ in Cupertino where, I think, he managed to show it to Steve Jobs. This was back in about 1999 or so just as Napster was it its peak. Apple bought the controlling rights to the device off Faddell - or something to that effect.

It is a very long and tedious legal process stopping people from ripping off your patented designs, just ask Callaway golf clubs about all the cheap knockoffs in Taiwan.

Microsoft was sued although not successfully by Apple back in the late 80's over Microsoft's copying of the original Macintosh GUI (and probably a bunch of other stuff too). In about 1987 Apple's then CEO John Sculley pretty much sold the family farm to Microsoft when he allowed them to continue to copy a large percentage of the Mactinosh GUI for Windows in exchange for getting Microsoft to keep developing software for the Macintosh platform which they were pretty much going to do anyway.

so seeing as they went through the trouble of patenting it, why not take action? it may be "long and tedious", but waiting for a longer period of time does not help them in any way.

see i know apple sued in the past, but i was referring to ms being sued over matters concerning vista, which some consumers already have (dunno if they were successful or not)
