If I have brought music on audio tape in the past - why shouldn't I be able to download mp3 versions for the internet?

I've read two different takes on this - One dated 2001 on a US site and a recent Oz site that suggested that format shifting was ok, but you had to do it yourself.

How do you think we get large music libraries of several thousand songs on your computers and music players? We rip them. :)
It is how ever illegal to download music that you haven't actually purchased unless the original artist is giving it away for FREE which some do.

IMEEM, which just went belly up, had a run-in with the MPAA/RIAA over this very issue .

Here's what happened . . . and what's going on now .

IMEEM was a streaming site for almost anything musical you could want . All you hadda do was stream it and on cue, turn on Audacity .

Welll . . . ex-c-u-u-u-u-se me! Not any more!

Policy wonks made it a requirement that you ALREADY HAVE IN YOUR OWN COMPUTER any of the music you would like to stream from their site .

You had to have the digitally-signed and authorized copy of the tune to let it play from their system . . . and it would check to make sure you did too!

I ask you>>>>>WHY would any sane person want to stream a song that they already own??????

Now . . since WE in the US have a "use by proxy" law on the books, it seems that WE . . . (not YOU in NZ) can actually have multiple forms of and copies of the song/movie as archives . . . . . . or of whatever if we actually can put our hands on the original copy somewhere in our primary place of residence .

But . . . . . if you have WMP11 . . there's a whole NEW can of worms with that too . . . just refuse to update to WMP11 from whatever version you currently have and you should be able to see/hear/view your own materials that you made too .

I don't download music illegally - however rather than place a cable between my stereo and optical input on my MacBook Pro and format shift the music from Tape to MP3... would downloading the Music as a form of format shifting be illegal or less illegal than if I didn't own the music in any format at all?

It is clear that the law is from a pre-digital age - however it seems that much of the law will continue to be rather silly and thus ignored.
I don't agree with stealing music, videos and software. However how many times will I need to pay for a song as formats and technology changes?

What people are trying to tell you in a sortta cryptic way without violating the laws of F1 is that any time you shift file-format-recording media, you are somewhere, somehow in the eyes of the RIAA breaking a really seriously punishable law .

Now we all know that there are SOME (read between the lines here) people who do this every day . Advocating such a heinous crime against humanity is NOT something you will hear on this site .

What YOU do in the privacy of your home is your business . . . and Oh! I forgot! It's also the concern of Micro$oft too .

Nobody here wants to meet Mr . Bill's RIAA/MPAA knee-breakers or the F1 site mods!

Remember that you do not own the music you bought; just like beer, it is only a rental .

I'm following you myke, your wanting to format shift the music from your tapes to MP3 or probably MP4 which is higher quality. Under NZ law that process is actually illegal but everybody ignores it because it is ridiculous. Yes you can do it and it is quite easy.

When you buy music in any form you are only buying the rights to listen to that music as the artist still owns it. You are not buying the rights to make a copy or copies of the music. That is where the issue of downloading and making copies of the music comes into play and where the changing the law to permit "fair use" becomes more sensible.
