328426 2005-02-27 01:17:00 A good silencer just happens to be $600-$1000 for my bike, and keeping a high performance motocross bike quiet is extremly hard.
We try to work in with them, but would just like to know the laws etc incase things get nasty, so I'm not the one in the wrong.

We have lived here for 12 years and been riding since day one, these people have only lived half here have of that time if that.

After 6 years of putting up with the noise of dirt bikes with no silencers it's a wonder that you have not come across a high tensile wire strung across your circuit yet.
They have bought a house in the country for a bit of peace & quiet and they are entitled to just that. Laws or no laws, consideration for other people is far more important.

328427 2005-02-27 06:58:00 My bike has a perfectly good factory yamaha silencer, which does its job very well considering the output of noise with no muffler.

Why do people assume the country is quiet? There are tractors, hay balers, motorbikes, cows mooing, sheep bahing, tankers, milk sheds, cow trucks, All of this is just as noisey as the city, but its just a different type of noise. If i moved to the city and complained about car noise past my house to the council, they would tell me to stick it for sure.

But then again, I know for a fact alot more of the locals LIKE watching me ride, doing jumps etc than people who dislike the noise.

328428 2005-02-27 08:47:00 tell neighbour to shove off, its your property, do what ever the hell you like. it seems to me that your neighbour is a real fuss pot and cant handle the jandle.

it would be insane to purchase a silencer for your bike, do you want to fork out money just to please your neighbour?? i certinaly wouldnt.....

what size of land are we taking here??

i say the neighbour doesnt like you because your young.....

328429 2005-02-27 08:53:00 well i'm sick of yafa's who move to the country for "a bit of peace & quiet" . . . . . . .

the cows moo to much, the cow shed makes to much noise, the cow shed radio is to loud, the milk tanker to noisy, the stock is stinky, hay has to much dust/pollen, bee hives are dangerous, duck shooting is evill and possums are cute cudly things we feed ! !

enjoy your bike riding :)

328430 2005-02-27 09:08:00 Finally good to see some support here...Our property is only about 20 acres, but there are sevral other blocks where bikes get riden too. hsv-b0y (5210)
328431 2005-02-27 09:35:00 I find that I'm with Sue and Godfather on this one. If hsv-b0y knows that (s)he is annoying neighbours, a lot of self-justification is not going to lead to a solution. A noisy milking machine at 7 AM does not have the same irritation factor as a noisy bike, or indeed a noisy Hi-Fi. Best learn early in life to get on with the neighbours...
Cheers anyway Tony

328432 2005-02-27 11:15:00 The cows, cowshed, tractor, milking machine etc are part of farmlife. If someone had to complain about this he would be laughed at as we all know that that is the engine of the economy and the farmers livelyhood.

However the dirtbike is probably 90% entertainment, and if your entertainment are annoying others then you should try and be considerate towards the neighbours as well who do not appreciate the same kind of entertainment as you do. Live and let live.

Personally I would fit a muffler if I was you, that way I can still enjoy my entertainment and keep the neighbours happy as well. I remember when I was young how a loud exhaust used to be music to my ears ( 4-in-1 open pipes on a Suzuki Katana), but one mans music is quite often anothers noise. Take music styles as an example, you may not like what others would kill for.

The last thing one need in life is bad blood between neighbours, you never need when you will need them one day in an emergency...

As long as the noise does not leave the property, that sentiment is fine.

If it does, then you are subject to the laws applying if a complaint is laid. And realistically you cannot "stop" the noise completely. A trail bike registers very effectively on noise recording equipment by the way, the entire noise energy is in the measured band, unlike stereo's with a high bass level.

Do whatever you can voluntarily to prevent a complaint being laid, because trust me, you will usually lose. That has major consequences for your future use of the bike on the property. Reaching an agreement with the neighbour is in the long run a far better result.

This is the process, by the way:

"Upon receipt of a complaint of "excessive noise" an enforcement officer is sent to the address. If he agrees that the noise is excessive i.e. of such a nature as to unreasonably interfere with the peace, comfort and convenience of any person he will issue an abatement notice to the occupiers of the address.

If they neglect or refuse to do anything about the noise the officer may enter the place where the noise is being made and seize and impound the source of the noise. He must have a policeman with him if the building is a dwelling house. Those powers are set out in section 323 of The Resource Management Act."

328435 2005-02-28 04:20:00 Take the bull by the horns, get in the noise control officer to take a DB reading from the complainers property.

The noise level won't be over any legal limit, being able to hear something doesn't make it ileagal.
