Microsoft also promised not to sue open source developers for making that software available for non-commercial use.Which is worse than useless, as it would require almost all open-source software to change to a far more restrictive licence. Things like the GPL, Apache & BSD licenses (under which a huge majority of open-source software is released) require commercial use to be permitted. In many cases where the GPL is used, changing the licence isn't feasible due to the inclusion of GPL code from other projects.

Yes, you can be sure that Microsoft's lawyers know this. The whole thing is nothing more than an attempt to pull the wool over the eyes of the media and the EU antitrust commission.

It's not really 'open' at all if you start putting these kinds of limits on what people can do with it.
