328585	2005-02-28 09:01:00	The All Black pleaded guilty to the assault after trying to force his wife, who was five months' pregnant at the time, back into the house during an argument . However, on Wednesday he was discharged without conviction . The court was told last week that, in October, the player attempted to drag his five-months pregnant wife back to their home when she left to go her mother's house . Judge Recordon said the All Black and his wife had undergone counselling and a conviction would be out of proportion to the offending . He said the assault, which would normally carry a maximum prison sentence of one year, was at the "lower end of the scale" . He said the man's wife, who was five months pregnant at the time, had left their house after a disagreement . "She kept walking while you tried to bring her back . You grabbed her . . . tried to pull her back towards the house . There was a struggle . " I'm sure he had very good reasons to attempt to forcibly detain his pregnant wife . I'm sure the police had no reason to charge him . He was probably pressured into pleading guilty . He probably had an unhappy childhood and feels misunderstood . It was probably a well meaning attempt to protect his spouse . And monkeys fly out of my @rse riding tv aerials As to his side of the story---- who gives a monkey's toss . He's guilty . End of my contribution to this thread . You missed my point completely . I didn't say the assault didn't happen - I made the comment about the degree of the assault and suggested the media sensationalised the story in an attempt to sell newspapers . 328587	2005-03-04 03:09:00	An article on the NZ Herald website, says that a website has named the all balck who was this week convicted and had permanent name suppression given in the assault of his wife. :angry Anyone been able to find the site.... :D Curious :confused: Have you found out his name yet ?, visited Google web site but still unable to source his name. trouble	trouble (7445)
328588	2005-03-04 03:46:00	This matter of name suppression depends not on the law, nor really on the actions of the guilty offender - but on the opinion of the Judge and his view of the world we live in. I don't know this Judge and don't want to. People, including press reporters, often forget that Judges are or were the average man in the street. Full of individual ideas, beliefs and opinions. And occasionally makers of mistakes. Years ago these lower court Judges were called Magistrates - until the government changed their titles and job descriptions to give them status. I can remember a senior lawyer telling me many years ago that many Magistrates were failed lawyers. They accepted a public servant type office job, working office hours and many evenings, on a fixed salary and, to his delight, could not play golf when it was a nice day. He explained that they could never become Q.C.s, nor generally be appointed to the higher court judge positions. He often compared his situation with his own virtually limitless salary, partnership in a big company, part time teaching at university, golf when it suited him, the possibility of becoming a QC and even becoming a real judge. His own boss...... None of this applies here, of course. It is not the complainant wife's decision that granted name suppression. It is not the All Black's decision that granted him name suppression - apparently everyone has the right to ask for it. The Police probably have the right to appeal if they don't like the outcome, I don't know. The man who made the decision probably knew more of the facts than the rest of us and he did what we pay him for. He decided. :cool:	Scouse (83)

328590	2005-03-04 04:55:00	All Black's name to be removed from website 04 March 2005 The lawyer for an All Black whose identity was suppressed when he appeared in court for assaulting his wife said today that the rugby player's name would have to be removed from a New Zealand website . In one of the "forum" pages on the site, a member of the public has identified the rugby player, who was discharged without conviction by a judge in west Auckland last week . On the same webpage, other members of the public have speculated, wrongly, about who they thought the offender was . Defence lawyer Richard Earwaker said naming the man was a breach of the court order for permanent name suppression and he would be taking instructions from the player's manager . "My advice would be to do something immediately about it in terms of trying to get it removed," he said . "We have to consider how it got there .
