345015 2005-04-22 03:05:00 Too much talk .

Too many weasel words .

Not enough accountability .

Not enough plain "man on the No . 47 bus" commonsense .

Cheers

345016 2005-04-22 06:50:00 Justice is conscience, not a personal conscience but the conscience of the whole of humanity. Those who clearly recognize the voice of their own conscience usually recognize also the voice of justice. Cicero (40)

Exactly what Demosthenes said!

Wise men, the ancient Greeks.

345018 2005-04-22 08:36:00 I have attributed to Alexander Solzhenitsyn:

None the less we greeks are no slugs when it comes to wisdom .

345019 2005-04-22 08:48:00 Hi Billy. Is this local? Not enough plain "man on the No. 47 bus" commonsense.. When I was a boy the common man was known as "The man on the Clapham Omnibus." Scouse (83)

Yes, it is local I guess. There are many versions, but I believe the original expression was first used in a UK judgment. Google might reveal more, but whatever the version, it expresses both the sentiment and the principle with admirable clarity.

345021 2005-04-22 12:05:00 Well done Scouse and Billy .

Lord Bowen, equated the reasonable man with 'the man on the Clapham omnibus' . Here in New Zealand a rather more recent judge likened the reasonable man to "the man on the Porirua unit . "

Sadly the Clapham omnibus no longer runs . . . . . . . . . . . . . . . . . . . . . A tragic day for forensic metaphor .

I might add that although the arguments might seem technical, they are nevertheless valid . Technical in law often means complex . Ie . most people cannot fathom the reasoning without learning a whole screed of other legal concepts . Too hard for me much of the time .

345022 2005-04-22 12:12:00 Not a nice analogy on the judges part, you would be hard put to find much reason in that quarter (Porirua unit). Cicero (40)
345023 2005-04-26 08:13:00 Berryman Petition to Government (www.organonarchitecture.co.nz) now available on the web, for downloading or printing.

Thanks for all help and support :)
