So just don't pay him for a few weeks to the value of your bond. Believe me the Tenancy's act is nothing but a wuss, and besides, I'm willing to bet a small amount that his contract's not 100% lawful. |

| 348165 | 2005-04-25 21:53:00 | I have read enough and listened to numerous experts on this one. DON'T withhold payment! It is an extremely good way to destroy your reputation as a tenant. Maybe it seems to work in the short term but long term... Tenancy Services are looking into a way to put their Decisions on line. Once this happens good landlords will be using it as one of their tools to select tenants. I'm fairly certain there was a tenancy summary in a recent magazine where the tenants were toasted by the judge for doing exactly what Greg suggests in similar circumstances. The contract is probably perfectly legal. The service the landlord is providing sounds as though it isn't. Another issue that could work in your favour for release from contract is the fact that you are subjected to second hand smoke of an illegal substance in the common areas (Health and Safety issue). Proof? "Er Judge, here's a jar containing the smell" "Er Judge, here's a police report saying the copper smelt it but did nothing" Maybe a letter from your Takeaway owner, another resident or an independant witness (or all of the above) saying they can smell it too. The landlord may or may not own the other unit. If he does he is permitting an illegal activity to occur on his premises. If he doesn't there is not a lot he can do about it. Tenancy Services provide a brilliant cheap solution for tenancy issues compared with the method used to enforce the Unit Titles Act (District Court, lawyers and vast wads of cash)! |

| 348166 | 2005-04-26 05:41:00 | just an update... tried ringing the tenancy people, no one would asnwer, and the are now closed until the morning. got home, and the downstairs door is now completley gone, if the land lord has taken it, he better be back with a new one tonight. or hes going to hear it from me. a broken door is bad enough, but having NO DOOR, in a place like Palmerston North is stupid. |

Long weekend etc may have meant solution 2 - make sure everyone has a key to the back door and board it up till repairs could take place. Option 3 - leave it as it for a few days then remove it completely is not an acceptable solution. |

| 348168 | 2005-04-26 12:18:00 | heh. just found another problem.... the roof in my flatmates room is leaking onto his bed. you can see the dampness, and there is areas where the paint as come away and the plaster is absolutley drenched. |

| 348170 | 2005-04-26 12:32:00 | well we havent figured out were we want to move to yet. yea he fixed it, just ripped the door down to the frame and put new wood on.. at the moment my flatmate is sleeping with a towel in his bed...poor bugger. |
