The dope-smoking, the vandalism, the strangers in your house, the party animals - sounds just like a uni hostel. Good thing you don't mention an aspiring heavy rock band. heh, nah. i would understand then, as it would be a student area. but this is in the middle of town. |

As it's a long weekend and Tenancy Services are probably closed I'd suggest a read of the Tenancy Services (www.dbh.govt.nz) site (click link Tenancy Services) and also the Residential Tenancies Act (also on that page). Now I know a landlord can issue a 10 day letter - have a look and see if tenants can do the same. Also, put everything to your landlord in writing! If you ring him to ask him to fix the door follow it up with a letter (Dear Sir, in reference to my phone call this morning about....) Keep a diary of events. Call Noise Control for parties Call the police for dope - if you feel up to it Is there a Body Corp you can contact? Write them a letter too. Photograph damage - and the repairs if substandard. Do you have a digital camera that shows the date? If not - a newspaper with the date on it. Ring Tenancy Services on Tuesday. Whatever you do - don't stop paying the rent or take other revenge on the landlord! That puts you in the wrong with Tenancy Services and causes you future hassles. |

Their smoking weed isn't affecting you, think carefully before you make it an issue and get the coppers involved.When push comes to shove the rules turn nasty and the players savage. |

| 348157 | 2005-04-24 14:40:00 | yea. the cops do not care about the neighbours dope addiction, as we had a police officer here earlier about the car getting gripped off, and at that time the stair well absolutley reeked of the stuff, but the cop could of cared less. i'll try my best to get everything down in writing, and give the Tenancy people a ring. this isnt the first time ive had to ring them. i previous land lord with another place thought it was fine to come in to the house without letting anyone know and clean our rooms ready for potential buyers. all without telling any of us. But the stupid thing is......is that she was a Real Estate Agent..... |

| 348158 | 2005-04-24 15:08:00 | if the landlord knows that there is pot being smoked on his premises he is breaking the law by allowing it and not doing anything about it. once you have told the LL your problems and he hasnt done any thing about it hand your notice in and let him fight it at the tenacy tribunal, just make sure you have proof. |

| 348159 | 2005-04-24 23:05:00 | I did a bit more research. There are 3 ways to break a fixed lease: 1. Walk away. Not recommended as it is illegal and has a huge potential to come back and bite you. 2. Negotiate with the landlord and seek permission to break the lease. The disadvantage of this one is that it may mean paying ads and doing the work to re-let it yourself. 3. Accumulate evidence and ask tenancy services to break the lease on your behalf. The car getting vandalised is not a reason in itself - you chose to rent a property without off-street parking - but this may add weight to other things. Particular breaches would be: - failure to attend as soon as practicable to health and safety issues (busted door) - entering premises without required notice (waking up to a serviceman in the kitchen if you haven't received 24 hours notice of his arrival is a classic example) - failure to fix significant faults within a reasonable time frame particularly if notification of a fault was via a 10 day letter. You are more likely to win at tenancy services if you have documented evidence of breaches. If it turns into a verbal battle it could go either way. Figure out what actual breaches have occurred, write them down, then ring tenancy services. |

| 348161 | 2005-04-24 23:57:00 | Minimum notice under the law for periodic tenancies is 3 weeks. Yes they may have trouble enforcing the law BUT... Bad Tenant sites are beginning to grow and build momentum. If your landlord was in the mood to use them you could well have trouble later. There's also the matter of references. Go the legal route - it's safer longterm. |
