I suggest you wouldn’t find a Jury that would find them not “Not Guilty” of Murder and even if you did, it would be up to them to reduce the charge to manslaughter.2: What do you actually have to do to get the maximum sentence for manslaughter?Remember, Manslaughter is Life Imprisonment, not 9 years! Yes, the “Spin Doctors” are using 17 years, but the reality is 9!These pricks got let off with a slap over the wrist with a wet tram ticket, courtesy of a benevolent Government which claims it can’t meddle with the Justice System, but then goes right ahead and does so. :mad:And how pissed off would you be back if they were found not guilty by the letter of law of murder.i think this finlayson explained thing quite well. plod (107)

Anyway the problem is our sentences. Even murder is lame, compare sentences here with a lot of the US.

So you see acting recklessly, knowing that death is likely, also qualifies you for a murder rap. I figure stomping on a child until his internal organs burst fits that category even if the IQ of the killers was less than their shoe size!

The other thing that irks me is it should have been up to a Jury to downgrade the charge from Murder to Manslaughter if they saw fit, not the Government.

Someone needs to remind them we are a democracy not a dictatorship! :mad:

Mmm....like they said, proving that one could have been tricky.

These people are not the brightest, bashing a kid, yeah....at which point do they sit and think, oh, that action may be a bit much and kid may die, I'll downgrade my action to a bit softer bashing instead? They don't.


I think we need to do 2 things:
1)Up the sentencing for stuff by loads
2)Stop putting kids in these sort of homes
How the hell do they get passed as care givers anyway? Friend of mine did it for a few years, the rigmarole she had to go through, so how the hell do they pass? And not get checked up on?

Might as well be the first Country to write Murder out of the Statutes.

Why not, there’s getting to be about the same number of both. :D

If I get a speeding ticket I’m going to tell them I might get off on a technicality, but I will plead guilty to exceeding 10min parking. ;)

on manslaughter vs murder, yes it sucks but a bird in the hand is worth two in the bush.
