359440 2005-05-29 12:35:00 Well sometimes the price can be good but there is a tradeoff when the what if's comes. Myself the manual isn't a big concern as I can download it the warranty does bug me thou if I got it from a actual store. And the cust service. Generally the warranty is 'just'. Its good luck or bad luck if the thing fails unless you are getting a item that does cost quite a bit ... like > $500.

If I wanted a cheap item, I mind as well get it off trademe from a good seller, least you can use their feedback to gain some trust or just them abroad from a reputable seller IMO. You get better cust service, price but of course you hope it does not break down within a yr. If you had to send it back at least you knew this was sort of possibility expected at the beginning and the level of service is prob better anyway.... even if you are a world away.

359442 2005-05-29 23:27:00 my family have bought phones from them, and we also bought a nokia 5140 from their east tamaki branch 2mths ago - no problems. they offer a "top up" deal which (if you select it) includes an extended warranty. dont have any experience with their technical service though. No he was wrong and yes, the CGA did apply, you were sold an incomplete product and they were obliged to put that right within a reasonable time or refund your money in full.

Because you were leaving the next day (you would have to provide proof) they were obliged to accept that as a limitation on what was deemed to be a "reasonable time" in your circumstances. If they couldn't provide the complete package within that time frame they should have given you your money back.

Ignorance of the law is no excuse.......for either party.

359444 2005-05-30 01:18:00 Billy, it's a product from a different country, one can not expect that it will come with an english manual. This is one of the issues with buying a parallel imported product to begin with. I don't see how the CGA comes into it at all. Jeremy (1197)
359445 2005-05-30 01:55:00 It doesnt matter where the product originates from. Parallel imported, imported or manufactured ... and it is sold in New Zealand, then the CGA still applies!!!!

Most of the sales people would have no idea what their obligations are under the CGA. If you are stuck in a situation, then quote the CGA ... usually gets a quick solution (in my experience). There is always the small claims court after that.

Ive bought two phones from them (one for somebody else). Very happy :)

359447 2005-05-30 05:58:00 Of course the CGA still applies to parallel imported goods, but I don't see where the CGA comes into effect just because there was no manual in the box. I wouldn't expect a parallel imported good to have an English manual in the first place. Jeremy (1197)
359448 2005-05-30 06:01:00 Bought a nokia 3530 a couple of years ago. No problems, came in the retail box and everything.

I've never heard of anyone getting dogged around there, in fact if there were any problems, they did everything to rectify.

I guess you can't please everyone though.
