372146 2005-07-14 21:16:00 Aussie justice throws a wobbly:

Seemed like a good idea at the time: build a Web directory of links to pirated mp3s around the world . Plaster it with advertising . Collect some ad dollars . Enjoy your retirement from the Queensland police force in style . But it wasn't . On Thursday Stephen Cooper, operator of just such a directory was found guilty Thursday of copyright infringement by an Australia Federal Court . In issuing its decision, the court said that Cooper, though he hadn't distributed the pirated music at issue in the case, had breached the country's Copyright Act by "permitting or sanctioning and facilitating" infringement s through his Web site . The court found against Cooper's ISP, Comcan, as well, saying it should have dropped the hammer on Cooper when it first learned of his activities . The ruling is a signifigant one - and frightening as well . "It confirmed that linking into infringing music is illegal," Music Industry Piracy Investigations general manager Michael Kerin told The Sidney Morning Herald . "It exposed the commercial role of internet service providers in internet piracy . "
