In saying that, most food retailers would replace dodgy food anyway, to keep customers happy.

If you haven't opened the box or packaging that the item came in you may find that the retailer will be happy to exchange the part for the one you require without any penalty.

Retailers cannot pass on opened goods to another customer as a brand new item and as customers expect things that are not "brand new" to be sold at a reduced price the retailer has to carry the loss unless he passes it on to the buyer returning the item not required hence the "re-stocking fee".

Ascent regularly offer at a reduced price and warranty products that have been returned due to being unsuitable.

I am probably gonna get sued for this, but there is a store here in the US that starts with the letter "S", ends with "s" and has a "t", and "a" and a "p" and an "l" and an "e" in it that DOES rebox returned goods and sells them as new . They have a whole department that is dedicated to putting opened and seal-cracked items back into like-new condition and then restocking them on the shelves next to the unopened ones .

They don't even care if the return was for defective . . . as a sale is a sale . . . hahahah

"To resell what has been sold before" is their motto .

Don't worry, there have been and still would be more than a few places here that do exactly the same thing and get away with it purely because the customer doesn't know any better . I have heard of places that didn't even bother to pretty up the packaging to make it look like brand new . :eek:

BTW: Leo has a nationally syndicated radio and streamcast here in the US for four hours every Sat and Sunday . I sent the url b4, but if you missed and want to hear it, I can resend it . . .

It's not quite how you've said it though . If someone has opened up the lid on a box and looked inside, then closed the lid again . This hasn't been used at all, but it has been "opened" . Even if it wasn't in it's packaging, it is still unused .

Of course it will all depend on whether the retailer is claiming that it is brand new or not as well .
