391072 2005-09-26 03:09:00 I got ADSL in Febauary this year on the free connection promo . through my ISP Actrix in conjunction with Telecom . In the contract with Telecom it says if you disconnect from Telecom within 12 months you have to pay the $99-99 connection fee . As most of you know Telecom has unbundled ADSL and has asked ISP's to market there own ADSL . I have since been charged the disconnection fee . To further explain please read emails I got from my ISP .

You may have heard in the news that there are changes occurring to the way in which DSL (high speed) broadband is being provisioned . Up until now, Telecom has provided JetStream, and Actrix, your ISP has provided the Internet services needed for you to use your broadband Internet connection . The exciting news is that now Actrix will be providing the full service to you .

In the past you have received two bills for your broadband connection: one from Telecom (appearing on your phone bill) and one from Actrix . Soon, Actrix will take over complete billing meaning you only get one bill for your broadband access instead of two . Over the next month or two, Actrix will be migrating you from JetStream to Actrix CyberJet, and putting you on an equivalent plan .

We think you will like the changes . We will soon be contacting you again with a description for the new plan type that you will be moving to, and we will be providing you with other options should you wish to go onto a different plan .

Hi Trevor,

Thanks for letting us know about the Telecom $99 . 99 fee . I've noted your details and will submit them to Telecom at the end of this month . You should see a $99 . 99 credit on your October or November bill . I wish redress could be more timely, but this is the framework stipulated by Telecom and we have little control over it .

Our belief is that you shouldn't have to pay the $99 . 99 fee, and that the matter should correct itself when Telecom issues credits to customers such as yourself . However, we understand that some customers who have not paid have been charged a $6 . 00 late fee, and some have even been threatened with being cut off if they don't pay it, despite the fact of impending credits .

We are not at all impressed with this approach by Telecom, but again, there is little we can do .

If you find yourself in a position where you feel you need to pay the $99 . 99 fee, we recommend that you do and await a refund or credit in due course . If paying this fee will constitute a hardship for you, Actrix is willing to credit your bank account with $99 . 99 and bill you for this amount later when Telecom refunds or credits your Telecom account .

391074 2005-09-26 07:00:00 Who has broken the contract, you or Telecom .

It could be argued that Telecom have changed the terms of service to such an extent in that you have been forced by same to change your plan, that the original agreement no longer exists .
