| 406179 | 2005-11-21 21:57:00 | I bought a cellphone off trademe the week before last. It was sent Saturday Delivery but didn't turn up on Saturday. Didn't arrive on Monday either, they said that they didn't know where it was! On Tuesday morning I got a call from Courier Post telling me that it was with the courier and would be delivered later that morning. I came home at lunchtime at it hadn't been delivered. I called Courier Post and they said it been delivered just before 10am. (As an interesting aside the driver also claimed to have delivered another item at 12:47 that day but he later admitted to delivering it at around 1:30pm... he said he had "accidentally" scanned it before he delivered it). Now they have declined my claim saying that it wasn't "signature required" so I don't have a case! Do I have any comeback or do I just have to accept Courier Posts decision? |

Go up to the post office and fill out the claim form. It doesn't matter whether its NZPost or CourierPost cause its the same thing. They take ages but they do pay out in the end. So long as its under $250. Thats the max they pay without having the item insured. When you get your claim letter - give the nice lady a ring - you'll find it will get sorted in the end. |

Years ago, NZ Couriers left my renewed, unsigned PASSPORT on the down the end of my driveway.... despite it being a signature required package. About 5 years ago, the same thing happened (at our new house - not sure if it was Courierpost of NZ Couriers), except they threw it over our back gate into our back yard. Just vanishes into a black whole after it gets picked up or in one case here at work it was signed for by some one who was out of the country at the time. I'd go back to their failing to comply with their contract to deliver on Saturday when you would have been home . That attaches some responsibility onto them . Their failure to deliver as contracted led directly to the theft, so refile your claim with a supporting letter . I have no doubt that the fine print will give them an out for failure to deliver on Saturday, but their admission on Monday that they had lost track of it will stand you in good stead if you have to go to the Disputes Tribunal . Don't actually mention the Tribunal yet because that might annoy them, and filing will cost you . You may yet succeed by other means . The next step is to move up a level of supervision and try with them . Keep going up the levels (ask to speak to their supervisor or the person they report to) until you reach somebody with the authority to deal with your complaint rather than just quoting rule books . Ask that question each time until you reach somebody who says yes . Write down the name of each person you talk to and the time you spoke to them . Keep notes of what they tell you so that you can keep the story straight, especially if anyone gets testy with you . The greatest weakness you might face would be having an inadequate mailbox which forced the delivery person to leave it on the step . However, if your front step is exposed to full view and easy access from the street, and your neighbourhood is perhaps not the best, you have an argument that the driver failed to use adequate judgement and care by leaving it there . In that situation they should have either returned again later, or left a card in your letterbox asking you to ring and say when you would be home . Either that, or return the package to the nearest post office for you to collect . If they don't come to the party and you have exhausted all other options, then tell the last (highest ranking) person to reject your claim that you will file with the Disputes Tribunal . They will not want that on their report to their superior . Nothing succeeds like patience, politeness and persistence . Cheers Billy 8-{) |

Yes, it stops any suggestion that you did receive the phone and now want to double-dip . It wouldn't do any harm to suggest to the Police that there is no proof of delivery and that the courier could have stolen it . Then you can tell CourierPost that you have notified the Police . If things get tense later on you might want to suggest to Post that the courier may not have even delivered it and that his records do not provide any independent proof that it was delivered as claimed . DO NOT suggest (to Post) that their Courier may have nicked it, just let them form their own conclusions . If you can contact the sender and get a description of the package, and also ask if the contents were described on the outside for any reason, that may prove useful too . Cheers Billy 8-{) |

Yes. But on the other side of the coin, I don't have any prooft that it wasn't delivered. :( |
