I'm just wondering what my rights as an employee are. I sometimes work a 9 hour shift with no breaks whatsoever. What is the legal entitlement for breaks? I've tried Googling, not too good with the old Google though. Alot of you seem quite knowledgeable on laws etc.
I've only started my job recently, so haven't signed any contracts yet.
Just wanting to know where I stand in terms of breaks. It's a real mission doing a long day with no breaks :groan:

412607 2005-12-14 10:47:00 For a start, I would question the legality of the fact that you have no contract, but is working. Without an employment contract, there is no formal agreement of anything in place. However, having said that, the law is still subject to your employment condition. Breaks are a must.... if you don't have them... then it's illegal in a sense. Check out the Department of Labour website for more info at http://www.dol.govt.nz techie (7177)

There is talk of changing the law to put in minimum requirements. There are though holdays and holiday pay provisions.

But as you don't seem to have a contract...they can do anything they like.

Even the tightest orchardists I worked for gave you a morning and afternoon break (during paid time).

Depending on what work you do it sounds dangerous. Of course if you get injured and have no employment contrct there would be problems.

Either you employer(s) are lazy or slave drivers. I'd just quit.

Even if you haven't signed a contract, the basic provisions of law apply.

412613 2005-12-14 20:05:00 Man that kinda sucks. I am working as a poolside superviser. Answering phones, keeping tidy, but also watching the kids in the pool. And i suck at swimming!!!
Anyways, yeah I prob will quit soon, just gonna wait to get paid first.. dunno what i can expect from my boss.

Thats not true - as others have posted - see the law on it. If no contract the standard one applies.

Yeah, true. I wasn't being that serious. The website says that you legally you need a written contract, but everyone is covered by the minimum rights (which are extremely basic). There is no standard contract though.

I sense a minimum wage in your future roddy_boy ;)
