My Bro has been dealing with baycorp advantage lately,
yeah he owed some money blah blah which is now fully paid, but the issue we're having is,
well i'm helping him sort it out, as when he got the letter explainging debt owing he rang them and explained
that he had just started a new job and wanted a extenstion to repay it as it was humananely
impossible to get the full balance within 7 days...and they gave him up to 15th of November,
which was a extra 14 days, if he didnt make full payment by then he'd have the "dirty" credit record
for 5 years, as well as having to repay the debt according to baycorps payment arrangement.
So we worked it out together and paid it off on the 11th of November, and that way he can have the clean credit record,
and pay me back a agreed sum per week, and today he went to hire purchase a couple of items he needs for his new flat next year during the interest free period
but the approval from the finance company came back saying no because
of his credit record showing a unpaid debt...and then he texted me and told me, so i rang baycorp on his behalf as hes at work till 1030pm
and they said, they have no record of the convosation taking place, and even if they said he had the extra 2 weeks, they still cant reverse the credit record...and told me that
nothing can adjust the credit record, he now has to wait 5 years for the record to go clean...
What can we do? its annoying how they demand payment within 7 days, and after negoiation to have the repayment length increased
and then find they didnt even follow their word...I also asked if theres a complaints process we can go through to possibily get the reversal to happen,
there was a very quick no to that. So hes now given up, but I'm not because I know they gave him their word of extenstion and the promise of a clean record, and i aint
letting them go back on that.
Can someone give me some advice here?

I've never known anyone to get a blackmark removed, You just have to live with it. :D

Give it a few months and try again,maybe with some record of earnings, A black mark means nothing as after a short stint you can slide right back into debt.

I had one for many years, managed to tick up a good 150 grand worth during the same period.

Do everything in writing.

Explain to the finance company, why there appears to be bad credit.

Get advice from a lawyer.

It is probably better just to buy used stuff anyway (at least cheaper).

411439 2005-12-09 11:16:00 Can't help much Chris. Your brother could complain to the Privacy Commissioner on the basis that Baycorp's info is wrong but it is a slim hope.

As Metla says, concentrate on getting some good credit history for the future. That will out-weigh this black mark and eventually it won't mean anything.

And actually you can get it removed if it was false. Happened to my husband. It was removed..

Just don't get into debt in the first place. Your bro is irresponsible. He had one debt already, only just starting a new job, borrows off you to pay it back and he goes in to get more stuff on time payment?

The black mark, what exactly does it do apart from obviously prevent you from getting hire purchases? would that happen for the entire 5 years? or just for now and when maybe you apply for a hire purchase in 2 years and they find you've stayed clean since that "blip" then your chances would be better? And at the same time save up and get yourself a good savings/credit record?

we have it in writing that even if its paid/unpaid it'd be there for 5 years....must have changed from 7?

are you saying you still managed to tick up 150grand of debt still? or you meant 150grand of savings?

No savings done in these here parts.

I didn't even find out I had a black mark untill I got finance declined on a $20 000 car, I just put more deposit on it and drove it home.....
