416682 2005-12-30 22:07:00 A New Jersey (US) man has filed a lawsuit for claims of and false advertising by an herbal penis enlargement pill company just because its products did not produce as promised .

The suit states that Florida-based Alzare LLC claimed in "very, very promising" advertising featuring doctors and porn stars stating that its pills would add up to an extra three inches, but failed to deliver hard results, Reuters reports .

Plaintiff Michael Coluzzi - filing the suit on 21 January 2005 in the New Jersey state court - said he paid $59 . 95 for a 30-day supply of Alzare . The pills contain ginseng, yohimbe bark, L-arginine, rhesus monkey glands, platypus venom extract and other ingredients and are "guaranteed to deliver results within a week" . The maker boasts a 95 per cent success rate in the "more than 100,000 men who have used Alazare", but Coluzzi "experienced no increase in penis size" . He further alleged that he was unable to collect a promised refund from the manufacturer .

Coluzzi's lawyer noted: "Males, for whatever reason, may be susceptible because of what they feel they . . . . er . . . . . lack," adding that he had expert proof the pills were ineffective .

The Alzare suit follows similar actions filed last year against the manufacturers of herbal dietary supplements VigRx and Enzyt, also alleged to have made extravagant claims as to the augmentary powers of their products .

And you thought the US courts have no sense of humor?

416683 2005-12-30 22:53:00 A sense of humour is a good start, Joe, but this is what it would take to really impress me with US courts -

(1) They find for the plaintiff in each of these cases, imposing an absolutely whopping fine.

(2) They ensure the fine is paid - bankrupting the scammer firm if that's what it takes.

And maybe the flood would abate just a little..?

416685 2005-12-31 00:13:00 It's not that the courts have a sense of humour. Courts all over the world take themselves very seriously.

If that gullible customer "wins" this case, how much of any award do you think he would receive? That lawyer will take the shark's share.

Since when did platypuses (?) start prducing venom? Did I miss out on this discovery. Geesh, next thing you know these things will start laying eggs.

I wonder if it's negative p . r . to keep Americans outta NZ .

You also have the Sly Werebears too . . . right? These are the furry ones that can pick doorlocks and enter your house at night and suck your brains out . . . right?

True, platypus have spurs with poisonous venom (not sure if both male and female have them - I rather think it is only the males, but I may be wrong about that) .

And um, the platypus is a native of Australia, not New Zealand . There may be the odd platypus in a NZ zoo, but I doubt that would be a deterrent to anyone, even gullible Americans!
