I have a question about an auction that i recently ran, where a bidder is requesting her money back but it was clearly stated that it is a AS IS sale, that i couldn't get it to go that one or both "may" go, bidder never asked questions about the problem, or asked before the auction finishes if they could have their money back if they were defunct ..... and it was never damaged in transit.

She has said that both components are defunt and has stated that she will file a dispute with Trade Me. I would be greatful of any advice.... do people just not read. It really is CAVEAT EMPTOR. Has she got a leg to stand on? It was a private sale.

Abit BD-70G V1.0 P4 Motherboard (out of a compaq d380mx PC)

I am auctioning this motherboard with a Intel Pentium 4 1.8GHZ Processor + heat sink n fan.

So one or the other, or both may work.

Can't seem to get this motherboard to work.... maybe there is something i'm missing.

So this is an AS IS sale.

You may just get a P4 1.8 CPU for a bargain price!

426721 2006-02-03 00:26:00 As much as I think the buyer knew they were taking a punt and is now just sour,...why do people even sell broken gear on Trademe?

And I would tell em to go ahead and lay a complaint, But then I wouldnt sell or buy broken gear in teh first place.

426722 2006-02-03 00:28:00 Trademe won't care. They have their fee which is all they care about. They may bother to tell the person to take it to the Disputes Tribunal but you did say it may not go.... pctek (84)

I Put it in at a $1 Reserve because i couldn't get it to go, stupid person! That's their stupidity...... the funny thing is, this is the first person that has sent me like an e-mail every few hrs since the auction closed, being a right pain in the A! LOL

You need to read the auction details again . . . . What does "As Is sale" mean?
And I never said one or both work, i said "So one or the other, or both may
work . " "MAY" I never said they did . . . . . Go ahead and call TradeMe, they
won't help .

You never asked questions in the auction, post feedback, i really don't
mind, as i will respond to it . . . . is always interesting reading through
peoples bad feedbacks, and seeing that some people, clearly, don't bother to
read or ask questions . I did list it as a $1 Reserve because of what i
stated in auction .

This is the response i received from buyer . . . .

By your response I can tell you knew it was defected on your auction it said 1 or both may work your wording was misleading and I tell what thanks for the retort as I will go in tomorrow and lodge a grievance against you will cost me $30 . 00 and you will have to appear in mediation which you wont be able to do and so I will win and you will be instructed to pay all cost and yes trade me will review your auction and the fact you have stated that one or the other or both may work is an indication of wether or not you mislead in your auction so this may be considered theft

Let the buyer beware. Also, how were you to know that it would fail then and there.
