If a person buys a computer with win oem installed and a backup on a seperate partition on his hard drive does this constitute "comes with windows". What happens if your disk breaksnor if you format the disk? Who is responsable for a replacement? If the maker refused to supply a new copy, how would he fare in the small claims tribunal? Come to think of it,it's not only windows. I had an HP for a very short while and if came with no disks. Drivers and other software were all backed up. |

| 467524 | 2006-07-01 04:13:00 | If you format the disk and lose a recovery partition, surely that's the result of your own stupidity. If the disk fails in the guarantee period, the manufacturer will replace it. That replacement will presumably have the recovery partition installed. If it fails outside the guarantee period, doubtless ... something will happen. You could probably say that it's up to Microsoft to replace it. The only guarantee that MS give on any of their software is that they will replace faulty media the software is provided on. (They specifically and explicitly exclude any obligation to supply software which works). :cool: |

What happens if your disk breaksnor if you format the disk? You need to use the restore discs. Some now have setups that provide links on the desktop to burn the restore copies for youself. Who is responsable for a replacement? The manufacturer of your system. Usually you have to pay $$$. Microsoft will only help you out if say the manufacturer has gone belly up. If the maker refused to supply a new copy, how would he fare in the small claims tribunal? Probably OK if they advertised that Windows is preinstalled and OEM copy of XP is not provided on CD. I don't really think it is much of a problem as most as websites you can just download them from and they will be more recent versions too. |

| 467526 | 2006-07-03 06:52:00 | something similar happened in my case too recently i had a "restore disc" that was basically a winxp cd with some xtras but... the prod key was written on the winxp book prodkey was invalid now i cant get xp working rang ms and ms said to get a new prodkey genrated that i had to have a photo of the disc and prooof of purchase so... anybody have a winxp cd and product key that they wish to sell ;) |
