An Oklahoma mother, Debbie Foster, was accused by the RIAA of copyright infringement back in November 2004, and her daughter Amanda was added to the complaint in July 2005. According to the RIAA, the Internet account paid for by Debbie Foster was used for file sharing, with an unspecified number of songs downloaded.

The music group offered to settle the case for US$5,000, but Foster decided to take her chances in court. She requested that the RIAA provide specifics such as the dates of the alleged downloading and the files involved. The RIAA failed to provide the requested information and Foster filed a motion for summary judgment. In turn, the RIAA decided to cut its losses and asked the court to withdraw its case. The court approved the RIAA's request, but named Foster the winner and awarded her attorneys fees over the RIAA's objections. :cool:

470816 2006-07-16 19:34:00 I had a major company try to sue me in court for losses they said I had caused them, and when we got into court, they didn't have proper documentation and they decided to drop the case .

I told the court that if they did drop the case I would sue for breach of promise, after all, they had told me they would pursue legal remedies to get me into court .

The judge was impressed and made them pay my cost in court, attorney's research fees (you cannot have an attorney present in small claims court in most states here) and punitive damage for reckless use of the court for the sake of harassment to me . They were fined by the court five-times the cost of their original complaint .

If someone threatens to sue me and fails to follow through with actual suit, I seek damages on breach of promise . It works .

I would love the RIAA to try that with me . . . .

The judgement gets set by gavel from the judge, and then I went to the bailiff and had a writ of execution served for a nominal fee as the agent for the prosecution was leaving .

Got him in time with in-court service and didn't have to hire a marshal to serve him outside .

Payment was in less than 14 days and included the cost of in-situ service . . :D

Nothing like making payments @ $5 a week to make you hate the system...
