Just wondering about some legal stuff here...

My mate got the **** beaten out of him on Wednesday night - 7 drunk guys were making a disturbance outside his flat, he went out to see what was going on, and one of the guys bottled him from behind and 4 of the others just started laying into him.
My sister was there, and saw the guy who bottled him. The police found some guys matching the descriptions, and my sister was able to ID the guy who bottled him. He was arrested, and will be charged with assault with a weapon.

Now, my question is this.. What happens next? I wanna see who the guy is, so am wondering if there are any way I am able to go to a hearing or whatever happens from this point.

480727 2006-08-25 11:55:00 IIRC since this seems to be just a general assault, the guy will go before the district court. If you know what day he is being charged, you should be able to sit in the public gallery. However, you may be sitting there for a while, as court starts at approx 9 am and finishes sometime in the afternoon. He will appear before the judge sometime during that time frame

I rememeber as a school thing I think, we were able to watch the proceedings. More recently, my partners second oldest seems to have a relationship with the local police (unfortunately not a good one). Oh well, we choose our own road to travel... all the advice in the world won't change that

Will the cops tell him when the Court date is? It's all good waiting all day, holidays just started! :D

I'm not unsympathetic, but if he couldn't hear exactly what was going on from inside, then he had no need to go outside. That was just inviting trouble, and it found him.

I'll bet there was a bit of abuse being hurled from both sides before the bottle hit him too.

More than once I've had to restrain Mrs T from jumping out of the car to take issue with some jerk or from wanting to go and discuss some idiot's attitude or parentage. I keep telling her that it is far better that they be the only mugs that wake up with a headache the next morning, and that I'm a lover not a fighter.

Actually, I won my last fight by 200 metres. :D

The guy that got beaten is a passive as dude, he was trying to reason with the guy who instigated it when he was doing the "wanna fight, dick?" stuff.

480732 2006-08-25 22:22:00 Never try to reason with people on drugs like P or alcohol. People who are high on such drugs tend to think they are bullet proof, and need to prove themselves.

Just call the cops and let the biggest gang in town deal with the intoxicated idiots. Either that or arm yourself to the teeth................ :D

As for the legal process, prepare yourself to be witness to more burocratic BS than you thought was possible, followed by more and more of the same.

Since when did a fire hose require urgent attention? I'll lay ten bob to a knob of goat sh*t (stakes to be held in your mouth) that he shot outside and engaged them in friendly banter before they had walked far enough away to not be able to hear him.

If in doubt, wait till dawn, a little water never hurt anybody, unless they jammed the hose through his window, in which case all he had to do was jam it straight back out.

480735 2006-08-26 09:55:00 The cops usually send whoever a summons to appear in a court . Which has a date and maybe time on it .

And if the offender/s dont appear on the day a warrant is issued by the judge .

And depending on how long it takes and whether the person pleads guilty or decides to stand before a jury, it can take ages . And a charge like assaullt with a weapon is a serious offence . and if it goes before a jury, it may also include someone like the crown solicitor etc . ie: Meredith Connell for instance if you're in Auckland .

And some courts also have victim advisers . So, if this guy needs assistance / info on whats happening, he/she can contact the court and get in touch with the victim advisers, who usually get your details, ie: Name, address, phone # etc, to let you know whats going on with the offender's court appearance .

It depends if the court is a closed court . (this usually happens when the offender is a youth) . In which case you or anyone can not enter the court .

They lock the door/s . Only immediate family (of the offender), can and staff from the courts or probation can go enter the courtroom .

If it isnt a closed court, anyone can go into the courtroom .
