508947 2006-12-23 12:34:00 It took 10 years from 1997 to 2007 for Kiwi's to have real "choice" for broadband INTERNET.As always, change happens ever soooooooooooooo slowly in N.Z.We are the "time warp" Dr Who stood for,and Telecom rode for all its worth. It has been a "stupendous catastrophic cluster [edit] arrangement, only Telecom could administer.Kiwi's left our shores in disgust and the international business community "looked the other way" when investing in our country.Tourists wondered where the hell they were when connecting to the internet compared with there home country, and they just gave up and went back home.Kiwi's and the international community "flipped the bird" to Telecom N.Z and it's *Shonky* monopoly and they begged for continued control of the landlines to the govt here in Kiwiland. The Govt after several years of [edit] around, finally "woke up" to the internet users "gun-powder" and said "stuff you"!.Here's hoping for 2007.....may all our dreams of normal OECD broadband speed come true,if not then Santa truly will have to leave a carrot in Telecoms Christmas stocking, so that on Christmas day they can sit on it and rotate until the "cows come home".Thats because N.Z will be using VDSL2 in 2007,and on that note I give the big "V" sign to Telecom for all the years of [edit] narrowband.....may all your bottom-line turn to cow dung from here on in!.:D

Very sad :( ======> www.clickz.com

Not forgetting Bugger was until recently profanity as well.So you should [edit] that too.Hold on....I'll do that for you.

B*****

It is entirely up to the reader to *read into that as he/she likes*.

If a complaint were laid with either you and/or your webmaster, then I would personally uphold my own post, and edit it via the administrator.I don't need a school teacher waving a ruler in my face.Especially when there are plenty of other forums here in S*** Hole N.Z to rant on.

If you don't respect my views here, I'll quite happily F*** Off and post my views elsewhere.

Freedom of expression is bound in law under the Bill of Rights 1990 with reference to section 14:

* A fundamental aspect of the right to freedom of expression is that it extends to protecting all information and opinion, however unpopular, offensive or distasteful.

www.justice.govt.nz

The law is designed to weigh up what is acceptable to all individuals. But in this case it only seeks to limit Violence - Racist - Hate speech.

* The right generally protects all expression that conveys or attempts to convey meaning except expressive activity that takes the form of violence.
Even though the right extends to all types of opinions, certain categories of expression (e.g., advertising, pornography or speech that incites racial violence) are more likely to be subject to reasonable limitations than others (e.g., political and social speech).
The scope of section 14 means that as all forms of expression except those that take the form of violence are protected by the right, any restriction on expressive activity will be considered in the context of section 5 of the Bill of Rights Act.

The above law is irrespective of your own website rules as per Fairfax.

2) No offensive language or user names (phonetic spellings included). Pressf1 is an all-ages forum and messages should be composed with this in mind.

That is because The Bill Of Rights Act 1990 although not Supreme Law in this country yet, does have teeth in any High Court in N.Z.This has been tested before and I'm more than happy with that ruling.

508950 2006-12-23 22:43:00 Yes, but private property rights trump freedom of expression rights. This forum is essentially a private club, whose rules you agreed to adhere to when you signed up. Get over it.

You can say what you like in your own house or on the street.

LMAO!

Private Property Rights do not trump Freedom Of Expression Rights in N . Z law . They are both upheld as equals in legislation .

Private Property Rights, although Amended into the Bill Of Rights Act in 2005,is not supreme law either . That means governance of both Private Property Rights and that of Freedom Of Expression Rights ensconced in the Bill Of Rights Act 1990 - are subject to legal examination in a court of law .

What that means to both parties is that Fairfax has the right to edit my posts, but I also have the expressed right to challenge that in a court of law, whereby I can obtain under "court order" - to Fairfax - that my post and/or posts be un-edited for a period that would be reasonably available, to the public under normal circumstances .

508952 2006-12-24 00:19:00 Go ahead and sue. Your posts became the property of Fairfax when you placed them on their website, and if they wish to destroy their property in the meantime it's up to them. You are guaranteed the right to express yourself using your own voice or your own means, but not guaranteed a commercial channel to do it. Go ahead and demand your right to TV3 to a slot to express your opinions. Be sure to take your lawyers.

You're not a friend of freedom or individual rights. You're like the bible-bashers who selectively quote scripture to violate everyone else's rights. You just want to cherry-pick the bits that suit you.

Fairfax Business Media has the right to remove, edit, move or close any thread for any reason and without notice or explanation. Fairfax Business Media reserves the right to ban or remove any member for any reason and without notice or explanation.

Real world. You agreed to these rules, you abide by them. If this forum is not to your liking, then I am sure you can find somewhere else to express your views in whatever language you like. However on this forum, the use of profanities is not acceptable and this is a rule most people have no problem following.
