508577 2006-12-23 00:03:00 Perhaps a claim against the seller of the bananas for selling a product unsuitable for use as a retaliatory instrument due to hazardous undeclared side-effects? ;) R2x1 (4628)
508578 2006-12-23 00:07:00 ...time to get rid of my brother then.

Stupid is as stupid does.

If you lived in the US you could sue him, since they sue each other for pretty ridiculous reasons over there. ;)

It's not useless for the lawyers, and that in the end is what the law is for. (That's just the reality, not the original intent) :illogical

508582 2006-12-24 02:32:00 Well, thanks for the feedback.. Basically sounds like I am a cock...

But it was my case, it was no where near anything sensitive inside the case, theres no way it would have caused damage to his computer.

I did expect repercussions but at the expense of my sensitive LCD screen? He is old enough (tho maybe not smart enough) to realise how sensitive an LCD screen may be.

Small courts claim maybe a bit extreme but why should I fit the bill for a (possible) new screen when I caused no damage (not even any danger) to his equipment?

Am I still a cock?

Yes you are, and the Small Claims Tribunal wouldn't even look at it until you had tried (and failed) to resolve it. You would have to bill your brother to establish a genuine dispute and also to quantify damages.

Are there no adults living in your house, (whatever your age, neither you nor your brother qualify for that apellation as yet) if so they should be taking an active role in getting this sorted.

Responsibility lies with you and your brother, probably 40% you, since you started it, and 60% your brother for his mindless and negligent escalation. Of course if he has no money, you are whistling Dixie however you attempt to address it, but it is worth a try to get him to accept some responsibility.

You will make more progress if you get a formal quote for repair, then he can see the extent of the physical and financial damage he caused and that might move him along a bit. What is the age and value of the laptop? You might get a replacement on Trade Me cheaper than replacing the screen.

Did you try cleaning the screen as I suggested with something other than alcohol? The longer you leave it the worse it could get.

Cheers

508585 2006-12-25 05:53:00 You will probably have to claim on your parent's insurance if you can't clean it - new laptop screens are expensive Greven (91)
508586 2006-12-25 06:02:00 Hmmm. If Insurers google on "laptop screen NZ" you better have a bannana clause in the policy. :O:horrified R2x1 (4628)
