| 530115 | 2007-03-04 22:15:00 | the antispam law in nz comes into effect on september 1st,but what about spammers who spam before september 1st this year? will they get away with it because the spam law doesn't come into effect yet? Or when the spam law does come into effect, will people who have spam before it came into effect be charged or can't the law backdate? | lance4k (4644) | ||
| 530116 | 2007-03-04 23:42:00 | It depends what other statutes are in place that can be used against spammers, precious few effective ones as I understand it, like 0. And no, the new law does not come in to effect until Sept, so prosecutions would be ultra vires .... unless there are transitional provisions, which are not usually put in place to get the jump on perps to gain prosecutions, but to allow Govt/ agencies time to implement the law. I don't think this law is retrospective either. So what's up, planning on getting a little spamming in before you can be nicked, eh! |

| 530117 | 2007-03-05 02:49:00 | Our NZ Government's attempt to stop Spam is noble yet futile in the face of the rest of the world ! The only way to stop Spam is for all ISP's to set up and join an ISP's association which bans the use of sending what is plainly spam. Then any one who gets spam could report it to their ISP and they would advise the host ISP who would delete that user. (under the terms of the ISP association) Then the only spam would come from ISP's that support spam and they would soon fast disappear. The fact is that many ISP's make money from spammers ! regards Digby |

Another futile law that is 100% unenforceable |
