738902 2009-01-15 05:36:00 Hey all,

So I thought I'd do a quick poll, Im curious to know the consensus from the rest of the world:
Section 92a & 92c of the Copyright Amendment Act assumes you're guilty by accusation, making it possible to have your internet connection terminated immediately by your ISP without warning simply because somebody "told on you". They dont even specifically have to have credible evidence.

Is this going to affect the way you browse? Will it change your habits at all? Do you care? Or dont you care? Thought of dobbing somebody in for a joke?

Poll coming ...

738904 2009-01-15 05:53:00 I generally don't pirate anything. I went fully legal when I switched to Vista. If I do download, it's usually old games which no one cares about any more. :D pcuser42 (130)

Yea I just downloaded the original Red Alert the other day.
Didn't realise they were giving it away.

738906 2009-01-15 06:16:00 I have to say that the phrase "Guilty by accusation" echos violation of one's democratic right to a fair trial...

Surey this infringes on the democratic principle that evidence needs to be presented to prove the guilt or innocence of an individual.

If upolding and enforcing the law was as easy as accusing someone of a "crime" why does this "guilty by accusation" activity not apply to all New Zealand law???

I think this is copyright protection gone mad!!! I'm not saying that you should not be able to protect your works but it needs to be done without infringing on the democratic rights of others... which in this case to me is one's right to a fair and just trial involving the presentation of evidence which proves either your guilt or innocence!!!

Cheers,

Have you never heard of infringement notices issued by the Police?

You can take an infringement notice to Court if you decide not to pay however.

In a court you can be found not guilty but you can't be found innocent for some reason.

A jury has two and only two verdicts.

A verdict of not guilty does not mean innocence. It just may mean the evidence presented was not enough to convict.

738910 2009-01-15 09:09:00 Well, I'm pretty sure that your ISP wouldn't dob you in. Also, I doubt this will come into effect on the 28th of Feb, the goverment has already said that the law is flawed, why would they pass a law that they know is flawed and could cause problems in the future? The only thing you'd want to stay clear of is public bittorrent trackers, cause the RIANZ could just jump on the tracker and collect IP addresses and report them. Other than that, just keep what you do underwraps, etc. (ie. Don't run around telling everyone you downloaded the newest XYZ) Netsukeninja (13296)
738911 2009-01-15 09:24:00 Either that, or tell everybody you're with that you have a different username with a different ISP ;) Chilling_Silence (9)
