543670 2007-04-23 23:59:00 After having an accident this morning on the way to work (got rear-ended, no injuries to the 3 parties involved) I suspect my car is going to be written off by insurance (find this out for sure when the assessor rings me later).

The car is currently in a towies yard. In the car is my kids car seat (of which one mounting bolt is bolted to the rear parcel tray), a few CD's, and the stereo (seperate amp, cd player).
Can I at any time legally acquire these items after the vehicle is written off (I will have to unbolt one seat bolt to get the earth cable for the amp but other than that it is free to be just taken out. The CD player is actually mounted to the floor)? Can the towie yard legally stop me from acquiring these goods from my car?
Are these my property, or will they be written off as part of the claim?

I'm just wondering what happens re: these things

543672 2007-04-24 00:25:00 Just pop down to the tow yard, and tell them that you need to get some items from your car. Shouldn't be a problem. The same thing happen to me
and I had no problems getting things.
If you are unsure ring your insurance company.

543674 2007-04-24 01:20:00 You might have problem getting anything in there that's fixed because the insurance will effectively own the car once they've written it off. Greg (193)
543675 2007-04-24 04:57:00 Once it's in the insurers hands you can't legally touch it. I was T-Boned once and the friendly cop said that the car looks like a right-off so if I were you I'd get anything like radios etc out before they get anywhere near it.
Plead with the car yard (Yeah Right) and see how you get on - but don't leave it long.

543676 2007-04-24 05:12:00 You have to take everything out now before they write it off.

I had to spend ages removing all my husbands tools and bits of plumbing gear from his once.

He had stuff for miles.
Literally.
Couldn't find everything after I also searched the paddock he crashed into.
Some farmer would have found a few brass connectors I think.

543677 2007-04-24 05:17:00 Went to see the towie, he was happy for me to grab odds and ends (socket set in the boot etc). He did say I couldnt get the stereo (ok coz its about 4 years old) but he would turn a blind eye as I got the (and in fact he helped me get the) amp.
Got kids seat too

Insurance rung later today, asked if I had any prefs for a panelbeater (I take it they haven't actually looked at the car.. the towie said more than likely they will write off)

Ironically, I got my friendly reminder today in the mail that my W.O.F is due next month :p

543679 2007-04-24 05:58:00 Um you can retreive the items as far as i know,

but as far as the car seat, in my understanding........when a childs car seat has been in an accident, this may be only if in use at the time? but im not sure on that....... they are usually not used again and plunket reccomends you replace them....... because they have been under stress and could have have unseen damage.
My SIL who is a nurse also says that, when involved in an accident they recommend them not to be used again.
Im not absolutely certain on this tho.

Hope you were all ok........
