546339 2007-05-02 11:30:00 i see in the paper (and seeing as there is a few feeveiw posts here) i see sky are banning their contractors (eg hills/signalmaster, the people who import one of the settop boxes and the only rural sky contractors (afaik) ) from installing any freeveiw boxes/dishs.

its not supprising one little bit.

the contractors must sit on there hands and do notheing when there is no work..... just in case they send you some. no doubt even the part time contractors have been told not to do freeveiw installs or else ! they do not like part time sub contractors at the best of times!

sky veiw is.. you must provide all the services like one of our hourly paid employe's would do, but we only pay you stuff all and only when there is work. even tho its not in your contract do what we say or you will not get the last months pay !

546341 2007-05-02 12:36:00 If they can't install it for you, you can install it yourself. Check out the internet guides, some recent sites about FreeView have it. You need some basic gears and your off.. Laying cables might be a problem though. msnforum (11610)

I seem to recall it was a case around holiday pay entitlement....

546343 2007-05-03 03:13:00 Isn't it a good thing we don't have Sky. :) pcuser42 (130)
546344 2007-05-03 03:17:00 Without Sky, you can only switch off, or watch the rubbish on free to air channels. Peter H (220)
546345 2007-05-03 05:23:00 IRD may well take an interest in this.

I'm sure SKY are keen to pay PAYE with all its accoutrements.

Does anyone have any clue re restraint of trade law in NZ?

546346 2007-05-03 05:54:00 Why would the IRD wake up now? In all sorts of areas the term "contractor" is an excuse by 1 side to avoid the responsibility of having employees and the the other side to do a few tax fiddles :) PaulD (232)
546347 2007-05-03 06:02:00 Sounds like SKY is another Telescum in the making - been resting on their laurels for years because there has been no competition, and now that there is some competition looming in the distance, they are running around like headless chickens trying to save the sinking ship. supertrouper (6665)

Ah yes but, a smart contract will have the contractor supplying some part of the goods and/or services (not sure if it needs to be both or how it could be for some businesses) to get around the IRD regs and rules. Even then, they may determine that the contractor is effectively an employee and charge the employer hefty PAYE penalties.

IRD do check it out from time to time, though perhaps more in some industries than others.

What about restraint of trade?
