I am on the side of Warehouse here - If you knew all the features you wanted why didnt you go in with a list and say can it do all this or even better yet, request to see the manual and read it yourself. The dvd recorder performed as it was designed and advertised to do. I think some of the onus was yours to ensure you chose a product that did what you wanted.

Of course what the staff members told you is what screwed up their side - not the CGA. The act says is it fit for a purpose (www.consumeraffairs.govt.nz) which I think it was.

552781 2007-05-24 19:50:00 Good comments everyone, thanks .

If I had perfect clarity of mind I would have asked about G-Code capability, but I forgot . There are many features to keep in mind and the instruction manuals are not always available to read, at any store . I doubt if many customers would want to stand in a store and read every page of a manual, trying to decide if a high tech item has all the features they want, especially if they have never owned a similar item . This is why I checked twice with two different service desk staffers about returning the item; I knew there were a lot of options to consider and I wanted the option of getting a full refund .

My point is that the two service desk staff members told me I could get a refund if the features did not meet my requirements . They did not tell me to read the box or the manual and make a decision before I made the purchase .

Let me say that over the years, at any Warehouse, staff members have been very good to deal with . Sometimes they will not know all details of a product but this is to be expected . They have always been polite, patient and helpful .

Considering everything now, I believe The Warehouse has a good policy regarding refunds and credit notes . It just needs to be clarified . Posters at the service desk should give details although I know that the disk and software policy is posted, other policies should be stated . However if it is left to the discretion of the manager maybe this is why it is not posted .

FWIW, a year ago I bought a bike at The Warehouse and am completely satisfied with it! :D Its not a mountain bike, just a road bike for keeping fit . I have recommended others to get the same bike and save paying double at a bike shop .

552782 2007-05-24 20:30:00 You bought a bike from the Warehouse?

God damn. Yes... I know... stupid... Feel free to call me stupid :p

Well good for you, but with mine I was not, although I am hard on things so I do need a high standard of quality... But just to be clear about the Warehouse bike... I had not had the distance to get tough on it (not even made it to the hills) :p I was just riding down the smooth road when it broke :stare:

552783 2007-05-24 21:56:00 My son bought one of their rubbish TVs. It lasted 3 months. SO I took it back for him.
They said their policy is to repair or replace electronic items. I made a fuss as I was standing right next to the Money Back sign which did not contain any small print with excuses or exceptions.
They got a manager who took one look and said I was obviously going to take the matter further (damn right) and told the girl to refund me.

Like I said, I have a rule, never buy anything with moving parts, electronics or electrics in it from the Warehouse.

I then went and bought my son a Sony which he still has after 3 years.

552786 2007-05-25 03:54:00 ... CGA...........if the product isn't fit for the purpose it's designed for/promoted as then it has to be either replaced/repaired or the money refunded:groan: A DVD recorder doesn't need to have G-code to be fit for its purpose: recording DVDs. If you want G-code, you look for a recorder which has a G-code symbol on the carton. That sort of thing is a feature. Manufacturers usually tell you about features. If they don't tell you that a feature is present, you have no grounds for complaint if it isn't present. Usually features aren't present if they're not "featured". Graham L (2)
552787 2007-05-25 03:57:00 I can't contribute any more to the above . I have sympathy for both Steve and the Warehouse . In this new age of consumerism we tend to forget about caveat emptor which does still apply .

Strictly the law says you should ask and make clear all of the functions you are expecting before buying . In this case it is a DVD recorder which works = fit for the purpose .

However I'm also sure that a judge would accept there are certain things common to DVD recorders which you don't have to spell out, thus the seller has to either repair, replace, or refund .

Underlying all of this is a general desire for shops to have a good image and many will refund just to keep customer goodwill, even when the customer is wrong .
