556410 2007-06-05 12:17:00 A couple of weeks ago, my brother was driving along a road, leading to a red light and three cars waiting at the lights. He gradually slows down to prepare to stop.

A woman at his left was coming into the intersection, which she has to give my brother the way - she is turning left, and my brother was coming from the right.

I don't know what went on in her absent mind, but she decided to turn left as my brother drove along, crashing into my car's upper-left indicator lights, and damaging the bumper. The woman's car is more damaged, though.

Anyways, we have waited for these 2 weeks for her insurance to cover the costs, but apparently she's trying to makes us pay 50/50 for the damages done. She says she wants to take this into tribunal, and making a false claim - saying my brother was speeding.

Why is that such a blatant claim? As my brother drove along the road that leads to a set of lights, the lights were red. Furthermore, there were already three cars in front of him, waiting for the lights to go green. He slowed down instead of speeding, to be able to stop behind the third car waiting at the lights.

Now she says my brother was speeding? I think she just wants my family to pay 50% of all damages done, instead of her having to pay up for everything, as she failed to abide to the give way rule.

She's now also trying to intimidate us to submission by claiming that her 'brother' is a 'police' and will have him investigate the scene, and the damages seen in the two cars.

What can my family, mainly my brother, can do about this?

Give her the finger, and/or refuse to acknowledge any dribble she sends your way.

Why do people even bother entertaining fools and their claims of crooked police brothers and threats of tribunals.

Call her bluff.

Keep in mind that she has no way, whatsoever, to show what speed your car was travelling at.

556413 2007-06-05 12:29:00 Thanks. We were thinking that she may well be bluffing, but we are skeptical.

I fear that my family being Asian plays a part in this. The woman is a European, and we all know the notorious stereotype of Asian drivers....

But I know for one that she failed to give way, and now she's saying that my brother was speeding - even if that was the case, shouldn't it deter her from turning, and into my brother's way?

556415 2007-06-05 14:08:00 lol, if she hits the side of your car it's pretty obvious she shouldn't have been pulling out infront of you. you should have called the police. when my brother had his bike written off by an unlicenced 15year old girl doing a u turn we went to their house (it happened just outside) and her dad made all sorts or threats. naturally we called the cops who charged her with dangerous driving and driving without a licence. she was audacious enough to give him a false phone number, even though he went to her house to issue the ticket, and then in small claims (of course she was uninsured and refused to pay, and we only 3rd fire &theft) she tried to say he hit her and she was parked, despite the cop's ticket. twice she was ordered to pay. twice we got nothing.

even if she does take you to court, there's not much in her favour considering your description of the accident

Mostly because the average Asian driver is actually pretty lousy and insecure on the road - especially the middle-aged ladies driving cars that are far too big for them to handle confidently .

I noticed an Asian lady the other day trying to park her biscuit sized vehicle in a really open park at Countdown - she literally took four ins and outs before she got the car parked . And then it still wasn't straight .

Even my Hong Kong Chinese mate says that Asian drivers are the worst! :lol:

Anyway - don't let that woman intimidate you - tell your brother to tell that woman to **** *** .

556417 2007-06-05 19:42:00 Let it go to tribunal. When in tribunal stick to the one story, being as clear and concise as possible. Take pictures of the area (with a camera) where the accident happened, showing where each car was, where they had come from etc.
I don't suppose you got any eye-witnesses to help with your story?

Granted asians do have a bad rep in this country (some truth but a lot of bigotry too) and she is just trying to use that against you and your family

She had insurance - so whats her problem? She only pays the excess.

Your insurance will mention it to hers.
