A friend who happens to be a serious-crash investigator says all an investigating police could do is give the ***** a fine. Other than that, the police cannot make her pay for the damages she's done.

We would bring the ***** to court, but my brother has no time as he is starting to work full time.

Is there any way to make this miscreant pay for the damages she's done?

Small claims court. They'll issue a court order for her to pay a certain amount, and that will be enforcable by the court.

556462 2007-06-08 04:42:00 Our insurance is for third party, so us being ran into will not be covered.

And it's not just a broken indicator. 2 broken indicators, severe damage to the left of the front bumper and the left side of the car's head, and the upper left wheel is cracked.

We're estimating the whole thing would cost us about $700, money we really can't spend right now......

George, as for the small claims court - will my brother have to attend it or does he just have to have a written testimony?

Even though you are only 3rd party both sides may be under some obligation to advise your insurers about the accident. If she wasn't insured you may be covered by your own insurance. State 3rd Party fire&theft covers "damage caused to your car by identified uninsured drivers of up to $3,000 and you won't have to pay any excess" PaulD (232)

We're with AA and I'm not sure how their third party works. Will have to ask my father when he gets home.

And as for the woman, she has insurance, although she won't claim anything, as she presumably wants to take us to tribunal and hope the referee will make it a 50/50, and to avoid having to pay higher premium fees.

God I hate her.

um, you may want to double check that, because when my family took that girl mentioned earlier to small claims we won (twice) but she never paid. she was meant to, but it was never actually enforced.

asfaik to actually get money out of her you need to pay a lawyer and sue her, then she is forced to pay, and it may only be at $10 a week:mad:

some people should not be allowed to drive simply because they refuse to pay for damages and can get away with it too (and that includes those who crash into your car and keep driving)

The Court cannot guarantee success . The process can take time .

Enforcement of Tribunal orders is not done in the same way as enforcement of Court fines . If you chose to enforce the Tribunal decision through the Court, you will be responsible for:

Applying or giving instructions for each step of the enforcement process .

Providing information the Court needs about the other party (sometimes known as the Judgment Debtor) and their property .

Checking progress on your case, for example that Court orders have been successfully served on the other party .

Get some sort of declaration from the police that she was at fault & your insurance company will do the rest

EDIT: Just read your other post. Insurance companies have much more success obtaining compensation. Your best bet is the small claims court, but she will probably ignore the ruling & you will have to get a debt collector involved if the damage is expensive enough to warrant that.

556469 2007-06-08 09:10:00 We'd love to taker her ass to court, but the problem is my brother will be starting a full time job in a couple of weeks, and we have learned that a tribunal case for this will open in 6-7 weeks.

So that means my brother will have absolutely have no time to attend the court meetings.

We are clueless on what to do now....court/tribunal are not an option as my brother has no time to attend the meetings, and even if a police investigation prove her to be at fault (which she totally is), she can only be fined at best, and not pay us for the damages.

$700!! My parents have made numerous payments ranging from buying a desperately needed second car, my school fees, bills, etc, etc......and even though I am willing to pay a portion of the $700, I'll be cut short of my university funds for next year!

God how I wish to destroy that miscreant's life!! Literally!

And I guess it doesn't hurt to ask: but does anybody have any spare lights for a 1993 Honda Ascot lying around? My family and I would be eternally grateful if anybody has any to give to us.

Also, noticed how the wheels are cracked? SHE must be the one speeding, as the wheel is obviously made of thick metal, and she must have been traveling at a high velocity to crack our wheel!
