If they accepted your claim, end of story.

The Tribunal will send a notice of hearing to you and you send it to your Insurer to handle on your behalf, there is nothing for you to worry about as the Insurance Company will want to get back their costs too. Your brother will need to appear to state his side of the story and she can only bring her action against him as the driver. If she brings it against you, you can write to the Courts and inform them that you were not involved and the lady has got the wrong person, but don't rely on that if your brother wants to get off. If you don't turn up to the hearing, the decision will go against you.

She will have great difficulty in pursuing her action I would think. Most referees at the Tribunal have heard it all before and make reasonable decisions. Just stick to your story and don't lose your head if she makes outrageous allegations, just be cool, all will be fine. What's more, she may not carry out her threat, if she troubles you anymore tell her to talk to either her's or your Insurance Company and let them sort it out! (tell her that it is no longer in your hands and your Insurer will not let you discuss it with her.

556434 2007-06-06 05:53:00 Mostly because the average Asian driver is actually pretty lousy and insecure on the road - especially the middle-aged ladies driving cars that are far too big for them to handle confidently.
This is one reason I don't drive.

I'm NZ born Chinese, 24 and do not drive. (no license)

Scares the creeps outta me when I get into the hot seat.

if only others would follow the same model

i myself will only drive our van/ute if i absolutely have to. i'm so used to my bike and starlet that in the larger vehicles i'm not confident that i know where the corners of the vehicle are - white male

I'm a perfect driver, of course. So I ride a bicycle.

just like elderly drivers with slowing reactions and cataracts, your typical chinese immigrant isn't used to what we call "normal".

so just because it's a stereotype doesn't mean it's always wrong

Agree. I keep hearing about Asians being bad drivers but I don't see it, even when driving in AKL. The only groups I can attribute "bad" to are young males who drive fast, inconsiderate and reckless; also the elderly in their 80s and 90s who drive too slow and haphazardly. But there are many exceptions. Back to Asians - I think we Kiwis need to be careful about stereotyping, otherwise we will end up being racists like many in aussie.

Particularly Pakuranga/Botany areas as well as Otahuhu and Mangere.

Half the time, they think they are in the right. Never mind the fact that they almost got run over by a wide load truck holding a large digger.

And don't get me started on Emergency vehicles.

Ambulances and Fire Engine drivers must have the most patience I have ever seen. Especially when the sirens are blaring and they are behind the bloody foreign drivers. Worse is when they smile back and wave. :waughh:
