This was being talked about on talkback today . . . . and it was raised that a week or so ago a cop in the US heard a "disturbance" in his basement, and the alarm sounded .

So he grabbed his RPG and went down to have a nosey . Saw the intruder, shot and killed them .

He must be gutted his 18 year-old daughter is now dead, after sneaking home through the basement because she was past her curfew . . . . . .

I thought it was illegal to have a loaded gun under the counter?

Illegal? Yes. Wrong? No.

Just because something is illegal doesn't make it wrong or unwise.

However....I don't think it's a fair comparison. A gun shop is always going to be a more lucrative target to mongrels and scum than say a place selling cheeseburgers.

If I ran a gun shop, yes I would.
If I ran a Burgers R Us, probably not.

556859 2007-06-07 08:32:00 The perperator derserves everything he got in this instance.I think people have the right to protect themselves,their property and in this case potentially the public from people like this. I think at times we live in a "nanny state" that seems more often than not, contrary to common sence to give more rights to the criminal than the victims. Now if I allege you stole an apple from MY tree on my property on the 33rd September you could argue there is no such date. You would also be correct. The alleged offence has not yet gone to the full law as it stands.

A deposition hearing is not a trial as such. Rather a question as to evidence.

If I were faced with a person holding a weapon I have no idea what I would do. The human instinct is to fight or flight.

I have an idea that the Police have once again made a mistake.

The guess here by me is that we do not want to greate a precedent.

If I own a Dairy and you come in with a weapon and want to rob me and I then hit you on the head with a can of cat food and you die. Am I guilty of Murder, Manslaughter or just defending myself and family?

556862 2007-06-07 09:36:00 The law is a bit funny about the use of force .

It says you are allowed to use "reasonable" force in some situations .

If the force causes death, that's usually considered unreasonable .

There's one situation I've come across where you are allowed to use "necessary" force if "reasonable" isn't enough . You would want to be pretty careful who you did that to . :D And the police would probably want to get a judge's opinion of whether it was justified .

Petrol stations do in fact lock doors do they not? It is illegal to get to 51KPH in a 50 KPH. Could you say you have never done that?

Circumstances alter cases. Well take the French crime passionel for example.

YOU walk in to YOUR place of abode and find your Wife in bed in a state of disarray clothing wise with your friend. Best Mate etc....

Now what would you do? Use kitchen knife? Walk away?

I somehow doubt you would actually KNOW what you would do.

Until faced with a situation you ( and I ) will not know how we would react.

Then I get a little worried about how you would treat me assuming I knock on YOUR door around 2:30 am and ask for POWER as my Wife has been disconnected and you decide to put a couple of .303 bullets in me.
