556420 2007-06-05 20:38:00 Thank you all.

My brother has a witness that confirms he wasn't speeding, although the woman says she has a witness saying my brother did speed. We're thinking she's yet again trying to intimidate us.

Insurance wise, she'll have to pay higher premiums next year for her insurance due to the accident - and that applies for my family's car as well. I certainly hate to think of having to waste even one cent because of that woman.

Not always, my car insurance with Vero doesn't penalise you if the other driver was at fault and can be identified.

556422 2007-06-05 22:12:00 If she is making threats about knowing someone in the Police and that you will be investigated etc, advise the police with a formal complaint and let them follow it up. If the threat is empty and they do follow up with her, might put some wind up her tail pipe.

Sounds like a classic case of White vs Asian, Asian go home attitude.

556423 2007-06-05 22:24:00 Get the police involved if you haven't already. Any competent crash investigator will be able to determine who hit who fairly easily. Let it go to the disputes tribunal if necessary - quite clearly there's no justified way in which she could win this. somebody (208)

556425 2007-06-05 22:54:00 Car going straight is hit by a car coming out of a side road on the left.
Traffic lights etc only relevant as to the possible speed of victims car.

556426 2007-06-05 23:11:00 US traffic laws add this to the fray:

Even if your brother WAS speeding and acting illegally, she had no right to hit him even if he was doing so.

The turning vehicle is ALWAYS at fault even in a case of illegal..but straight driving by the other individual.

One may not cause an accident by hitting an illegally operated vehicle.

556428 2007-06-06 01:09:00 The mere fact she is wanting to go 50/50 means she accepts she has done some wrong. If your description is accurate then she is responsible 100% so therefore should pay.

I have been involved in a couple of these before (witness) and in both cases it is the insurance co. (aka a$$holes) that take these matters to court. I wonder if they have some influence in this issue - either way take it all the way and like others have said, dont sway from your story. Stand fast.

556429 2007-06-06 02:53:00 If you let her sway you, you've lost (even though you are in the right!). Road accidents should ALWAYS be reported to the police asap, I think within a max of 60 hours limit if you want them to give you a report for the insurance company. Even if you haven't done this, from what you say it sounds there is sufficient evidence from your side anyways as to who is right and who is wrong. She hit your brothers car on its side in an intersection, does it get any more obvious? Deathwish (143)
