| 556420 | 2007-06-05 20:38:00 | Thank you all. My brother has a witness that confirms he wasn't speeding, although the woman says she has a witness saying my brother did speed. We're thinking she's yet again trying to intimidate us. Insurance wise, she'll have to pay higher premiums next year for her insurance due to the accident - and that applies for my family's car as well. I certainly hate to think of having to waste even one cent because of that woman. |

If the threat is empty and they do follow up with her, might put some wind up her tail pipe. Sounds like a classic case of White vs Asian, Asian go home attitude. |

The turning vehicle is ALWAYS at fault even in a case of illegal..but straight driving by the other individual. One may not cause an accident by hitting an illegally operated vehicle. |

If your description is accurate then she is responsible 100% so therefore should pay. I have been involved in a couple of these before (witness) and in both cases it is the insurance co. (aka a$$holes) that take these matters to court. I wonder if they have some influence in this issue - either way take it all the way and like others have said, dont sway from your story. Stand fast. |

Road accidents should ALWAYS be reported to the police asap, I think within a max of 60 hours limit if you want them to give you a report for the insurance company. Even if you haven't done this, from what you say it sounds there is sufficient evidence from your side anyways as to who is right and who is wrong.
