Gunshop worker Greg Carvell will not face trial on a charge of possession of a pistol for unlawful purposes.

In the Auckland District Court today two justices of the peace said there was insufficient evidence for the charge to proceed.

Mr Carvell shot Ricky James Beckham in the stomach with a .45 calibre revolver when Beckham entered Carvell's south Auckland gunshop in July, threatened staff with a machete and demanded guns.

Beckham was jailed for two years and nine months for aggravated burglary.

Yesterday, the court was told that after shooting a machete-welding man, Mr Carvell started crying and repeatedly said "why did you do it, why did you make me do it?"

The 34-year offered medical advice, then handed the black .45-calibre colt pistol he had just fired to his colleague and rushed to the door of Small Arms International to keep customers out until police arrived.

Police decided not to charge Mr Carvell for shooting Beckham but did lay a charge of possession of a pistol for unlawful purposes.

Mr Carvell's colleague Bruce Motley yesterday called for the two Justices of the Peace hearing the depositions to not commit Carvell to trial, saying there was insufficient evidence to establish a prima facie case.

He said Mr Carvell's actions saved two lives and prevented firearms from getting into "extremely dangerous hands".

Appeals? I bet the prosecutor doesn't have that much common sense otherwise we wouldn't have had the case in the first place.

556849 2007-06-07 05:55:00 Don't talk about common sense, there's a bank in wellinton that screens people before they walk in, if the security guy doesn't like the look of you the door doesn't open. If the gun shop was concerned about security they'd had a similar system rather than an illegal loaded weapon under the counter.

edit - the "Tui Ad" claim was that it wasn't loaded, the magazine needed to be pushed home and the slide racked.

Naturally, the gun shop is going to have a similar budget to a bank to install such security measures?

Shooting some toe-rag probably achieves a similar result at much less expense. Also comes with the added bonus that next time he might do the job properly.
