562889 2007-06-25 10:54:00 I was recently sold a faulty 7900GT card. It runs with a PCIE adapter, but when it played a game for 5 minutes, the computer crashed, and would not boot again until the 7900GT is replaced.

The seller who I bought it off actually bought it from someone else on trademe only 2 weeks ago, who clearly stated the major fault in the card. When I bought it from my fraudulent seller, he said he's had it for 18 months (were 7900GTs released then?) and that 'there is nothing wrong with it'.

I have given him 5 days chance to redeem himself, but he refused to reply to my emails. Just 2 days ago a friend of mine suggested I take him to the Dispute Tribunal, which needed the seller's address, contact numbers, etc....

After contacting trademe, trademe sent me a form which has to be signed by me, and a Deputy Registrar and sent back to trademe, so trademe can be sure I will only use the seller's details for this purpose only.

My question is - where can I find a Deputy Registrar? And where is the nearest place where my hearing will take place? Will it be in the court, or some sort of office of the referee?

562890 2007-06-25 11:25:00 It would help if you said where you live, but the local courthouse is a good place to go for the Registrar. In bigger cities the Disputes Tribunal is usually co-located with the District Court, your phone book will find it for you.

The Tribunal cannot compel the seller to attend, and if they find against him you will still have an uphill battle to get any money off him. Still, you should use the process anyway and if it turns to custard, see if TM will then ban him. I'd email telling him you propose to go to the Tribunal, and that if he fails to front you'll ask TM to ban him. That might get some response.

You could also put polite comments on some of his auctions telling your story and warning bidders of possible problems. Keep it fairly laid back though or you might be the one who ends up banned. You might also like to tell us his TM name so that we don't get caught by his tricks.

Cheers

Thanks Billy . My phone books are being borrowed (for well over a month!) by a friend, so I can't search . I live in Massey West, very close to Westgate .

I advise you all to exercise caution when bidding for a1exw's auctions .

Do you think TM will ban a1exw if I told TM the whole story?

You do know that phone books are absolutely free from your local post shop right? and if you need large quantities then that directory guys will even deliver them.

So you found that out . Probably by reading his feedback and seeing he had bought it right?

Pity you didn't do that before you bought it . I always read their feedback .
Like read it, and see what they bought/sold, not just look at the smiley faces or whatever .

562897 2007-06-26 05:20:00 I'm pleasantly surprised that Trade Me has been so cooperative. I had a similar situation once and they weren't interested at all. I ended up just losing the money.

I recommend you go to your nearest court, and go to the Disputes Tribunal (which is in there), and ask them about it.

Does the trader have a lot of feedbacks? If so, you can probably get sorted out by just threatening to have him banned.

How much is the card worth?

562898 2007-06-26 07:02:00 I had a look at his feedback and stuff.
I doubt he'd get banned. Trademe a very xxx about that. He'd have to have a lot of negative comments.

He didn't mention the card was stuffed though.
