| 562899 | 2007-06-26 08:07:00 | He didn't mention the card was stuffed though. He also mentioned he had it for 18 months. George - he did a deal of a case, with fans etc, a 17" CRT monitor and the card for a buy now of $250. That seemed like a reasonable price for the combo, so I took it. But after I had it, I noticed the reserve was only a mere $100. Had a talk with YouthLaw and CAB this evening....they were rooting for me and a lawyer from YouthLaw is offering me help with writing up the case and giving me constant advice. You all please take caution with a1exw. I want him to get the worst image on trademe. |

| 562900 | 2007-06-26 08:20:00 | qazwsxokmijn I recommend you post bad feedback now - probably a good first step. A recent, scathing feedback would always completely turn me away from a seller. The guys at Youthlaw sound great. |

| 562902 | 2007-06-26 08:29:00 | qazwsxokmijn I recommend you post bad feedback now - probably a good first step. A recent, scathing feedback would always completely turn me away from a seller. The guys at Youthlaw sound great. I posted a bad feedback, but deleted it. I was unsure if the card actually worked to its full capability or not - hence I put it up for $1 because back then I thought there was nothing I could do to get my $250 back. After I found out he sold me a faulty item, I deleted the feedback because I did not want to change it to positive - which would be wrong. The card is very funny - it ran desktop applications just fine, only if you do not plug in the PCIE cable or use a PCIE adapter, as opposed to PCIE cable straight from the PSU. But when I tried to run a game with it, the computer crashed and refused to boot. Plod: I'm 17 And yeah, YouthLaw was terrific. They couldn't do much, hearing-wise, but they are good support. |

The reason I ask, is that it says in TM term and conditions that you have to be 18. [QUOTE]Becoming a member is free. You may only register as a member if you are resident in New Zealand or Australia and can form a legally binding contract that is enforceable against you. For example, you must be 18 years old. By registering as a member, you warrant that you can form a legally binding contract. /QUOTE] I am not sure how that will affect your case this might help from the consumer website "Online auctions where you buy from a one-off, private seller are regarded as "private sales". You have limited protection, since private sales are not covered by either the Fair Trading Act or the Consumer Guarantees Act. However, contract law does apply: for example, the seller can't refuse to supply, or supply the wrong thing: and buyers must pay up. You may also have some protection from the Contractual Remedies Act, but you'd need to be able to prove that: you bought an item based on information provided by the seller, and that information provided by the seller was wrong, and the false information provided by the seller meant you have lost money. The terms and conditions on any auction site will be binding unless they contravene your statutory rights." |

| 562905 | 2007-06-26 09:22:00 | :D Ut oh! I think you're stuffed Qaz.:D No offense to Qaz or anyone else under the age of 18, but these rules are put in place for a reason. And to think Sue wants the voting age lowered to 16 |

| 562906 | 2007-06-26 10:01:00 | Ut oh! I think you're stuffed Qaz. Ah....under 18s make quite a significant segment of TM's market.... But then again, my account is technically my parent's account, although I am mainly the one to use it. My parents did supervise what I bought and sold during my first year in TM. I am neither sure how this will affect the referee's final decision, but I do hope I have his support. you bought an item based on information provided by the seller, and that information provided by the seller was wrong, and the false information provided by the seller meant you have lost money. The terms and conditions on any auction site will be binding unless they contravene your statutory rights." a1exw violated all that. I bought the items based on the information a1exw gave me - that the card is 'playing well' and that 'there is nothing wrong with it'. |

You do the bad feedback, why would you even consider changing it to good? And you find he knew it was knackered so you delete the bad feedback. Crazy. |
