I am no legal expert by any means, but you showed a picture of a case and that is what he thought he was buying, but what you gave him (I know it was an accident that you got the wrong case... but to him it is not...) was different... I could be wrong, but I see if as false advertising (accidental yes)... but you did offer to swap the cases :) I would keep the deposit cause as you explained the deposit was to ensure he doesn't pull out. EDIT on 2nd thoughts I would give a full refund and get him out of it for good... |

And as CGA says, has to be a good reason for a refund, not I changed my mind. he didn't change his mind, goods advertised were not the goods supplied. Sorry George, but I would also be asking for a refund. And the CGA say's he's entitled to one |

| 570765 | 2007-07-21 03:43:00 | No. George said: because the case is different (although very similar) to the one pictured in the Trade Me auction. The problem is, even though I offered to swap the case for him, he just wants a refund. So its not totally different and he was offered a case replacement. |

At least the case that I know about from TradeMe. Possibly. The customer has the right to ensure He/She gets what they pay for. |

The customer did not change their mind. In this case (sic) it would appear that the customer did NOT get what was ordered and paid for. In this case the customer may have a case as it were. |

George - keep the deposit; you're entitled to it. the customer may be a moron, but he is still entitled to a full refund including deposit. It's simple. This should really be a lesson for George to check what he has ordered |

| 570772 | 2007-07-21 05:20:00 | Unfortunately no matter how much of a moron the customer may be, they are ultimately your boss since with no custom your business wouldn't exist. The one rule about customers is that they are always right no matter how wrong you think they are. I would refund the annoying prat everything except for the non refundable deposit, that way you get rid of them and they can't say that you have ripped them off and you get to do business with someone else another day. | winmacguy (3367) | ||
