574488 2007-07-31 06:21:00 Given this is a technology forum...and I now have 2 x PS3's thought I'd chance my arm by asking...Sorry if it doesn't quite match most of the posts in this wonderful forum...

Bought an SXRD television and received about 6 weeks later a PS3 through the redemption scheme Sony ran....Sony had a bit of trouble understanding if one had been posted out or not but we got it in the end.

Then today, about 5 weeks later my wife heads off to the courier depot to find another big box from Sony - ANOTHER PS3 - they must like me.:thumbs:

I would love to keep it but the better half of me has sent an email to the contact at Sony informing them of their error.. Before I speak to them and try to negotiate some small freebie from them e.g a game - for the good lady's time and effort :) no-one in my office could quote how the law would interpret this error - as in - could I legally keep it? or would I be legally obliged to return it...?

Just curious to be honest..It might also help my case in getting a game:)

Unsolicited things we receive in the mail are yours/ours to keep...but this is just a mistake by Sony and it will be found out...and in the end if you keep mum, it'll be fraud with the intent to keep mistaken goods.

Them giving away 1 free PS3 is nothing to them, and they prolly won't follow up on it anymore (unless you get a phonecall, then be worried) .

They'd prolly be too stubborn to give you a game in return for it, more of a "We are Sony, do as we say" response most likely .

Sell the PS3 and buy 7 - 11 games with the money .

Chances are every time you call you will speak to a different person so see if all of Sony's staff will send you one - just as a test of course..........

To SurferJoe....You may have already noticed in my email, my conscience has been involved and I have already sent an email notifying them of their error...

The question was one around the law (in NZ) regarding this error..

No-one I asked could answer it, short of having an 'opinion'..

574494 2007-07-31 08:04:00 I'm not a lawyer but in MHO it would be legally wrong to keep something that you know isn’t yours.

It is not yours because you already have the one Sony gave you, and if it's not yours it must be Sonys.

But if it were me I would have probably just put it down to good luck and keep it.

Yes, I would do nothing, and wait for them to contact you . It will be more embarrassing for them to admit that they have made a mistake, and you could tell them that you have had it sitting be the door and you hadn't got a round to calling them about it . Basically it is their inefficiency, and why should you have to waste your time fixing their errors .
If they never contact you after 3-4 months either use or sell it, it will be yours to keep .

I don't like Sony NZ, and find their customer support poor . I am still waiting for them to get back to me regarding a repair on my LCD TV that has a problem with the speakers . I contacted them in February, and I have a job number, but no one has got back to me to pick it up for repair . I will get back to them before the warranty is up, as it is not a major problem .

That is incorrect and it certainly isn't fraud . www.consumeraffairs.govt.nz
