1436391 2017-06-10 21:46:00 Hey all, don't know where to start on this one so I will dot points.

Me and my ex de facto partner been spilt up for 5 years now. Only problem her name is still on the deed for the house I ask if she can take it off and we make an agreement how much I should pay her out.

Got the house in 2008, I used my another house as the deposit on the house as she had no savings .
Got the house in April with housemates . I got posted overseas for 6 mths then when I got bask from I got posted to waiouru for 2 years only lived in the house during weekends.

2011 moved back in the house , same year she thought I cheated so I moved into a different bedroom for awhile. Only had sex once this year. Same year 2011 she started nursing college which I help with. She got her super payout from her ex Jon and spent it on her herself fix her teeth and got a puppy. I don't touch one cent from it. Oct 2011 got posted overseas again at this time we spilt up.

2012 - 2014 she stayed in the house I still paid mortgage payments rates etc etc. 2013 I moved back in the house separate bedroom didn't have sex. She was getting money from study link . Student allowance now.

2014 she moved up north got a job. She still paid the half the mortgage.

Last mth I ask her to take her name of the deed of house and we can work something out as i had pay for a new roof , odds and ends around the place .

I also said she can take anything she wants from the house.

Got a email from her lawyer saying

I need to show her all of accounts from the day we spilt up ( April 12) plus my government super.

Is there an time limited people can claim this ? She never put any money in my accounts or super. We had different accounts . Apart from 2. 1 was where we put money in for the payments , one was savings for rates and one was from the flat account all people living the house put money in that one.

What can I do ? Anything?

Il understand she get . Half of the house we got together . Bummer but it is what is it .

1436396 2017-06-11 06:04:00 Get a lawyer and get yourself out of the situation as soon and as cheaply as you can. I think you will find that the time is not in your interest there is always two sides to the story and the law does seem to favor the females in this situation. CliveM (6007)

So she can get half of my stuff and I can't touch her stuff as she left her job to become a nurse . Seems like I've a big fight .

In hindsight (that wonderful thing you experience when it's too late) - pre-nupts are the way to go. Wish I had :groan:

Let me relay a little story of my Brother-in-law.

He earned very good money working overseas and was saving for the future by purchasing houses.

He got up to three when he and his wife split, but they sat down and agreed that they would have a house each and sell the third , splitting the proceeds.

So off to the Lawyer they went, but the Lawyer said he really couldn’t act for both of them, and because he had acted for the family for years he felt obliged to act for the brother-in-law and the sister-in-law would have to find someone else.

So off she goes and finds a female Lawyer who advises she could get the sister-in-law a much better deal than what she was proposing.

Then it was all on, and in the end neither wound up with anything because the proceeds of the sale of three houses just covered the two Lawyers fees when settlement was reached. Odd that.

So here we had the classic case of two farmers fighting over a cow. One’s pulling its head, one’s pulling its tail, and the Lawyers milking it. :D
