589196 2007-09-09 05:01:00 I'm not siding with the seller, I'm just pointing out the facts. You don't have to quote the CGA to me as I'm fairly versed in its meaning. There is alot of interpertation in it. I had an episode with the CGA a couple of years ago which I won't go into here.

No, you have it totally wrong... the CGA is there for the benefit of the public, not the seller. The customer cannot be expected to know it's something 'minor' like faulty ram and it's obvious the salesperson wouldn't know either. It's also not the customer's fault that NL staff wouldn't have a clue about using a screwdriver and removing the extra ram to see if that fixed the problem.

The laptop switches off after 15 minutes making it unusable- end of story. If it couldn't be fixed on the spot the customer would be entitled to a refund, as that is considered a substantial problem within a very short time of purchase.

There is nothing ambiguous about the part of the CGA I quoted, and I have seen the wording in practice in disputes tribunals etc. I will agree that it's one of the less ambiguous parts of the act though.

Oh it doesn't really matter if she was an ex or just a normal friend . She doesn't know much about computers so she she asked me for some help

I disagree. A computer is a complex device, unlike a TV or a toaster, which should work straight away when you switch it on. A PC has both software (if Vista then it has bugs) and hardware, which either or could be causing the issue. It is however most likely the new ram. Yes both the sales person and the consumer shouldn't be expected to know what it wrong with it on the spot, and that is why I believe it is reasonable to let Noel Leemings technical people (or their service people) look at it to see what the issue is. From the post, it appears that it was their service people, and not the sales person who installed the extra ram anyway. They may then decide to switch it for a new one. However the problem may be very simple.
If they were demanding a replacement, then they may as well just ask for a refund and buy elsewhere.

if someone searches "Noel Leemings" on this site they will find a story of bad service, too many bad threads about one company will drive off customers :-)

and to play fair , if they do replace the laptop then let us know of what good service you got from the shop.

1. Speak with the manager yourself, not just your gf. Be polite and not angry. If the manager will not help, leave quietly and then...

2. Contact Noel Lemmings head office - Google it. Send an email to a specific person - ring and ask for the appropriate person's name if its not on the web site. In your email give the URL of this thread, plus the name of the manager at your local store.

Either the sales person or your gf is giving you the runaround. The manager will probably sort it out no problems but if not, head office will when they know the problem has gone on the web for all to see.

It is being sorted out. They are repairing it. Thats there choice under the CGA which they are entitled to do. I'm not siding with the seller, this is how the CGA works.
