2. Operating Speed Measuring Devices

The following guidelines apply to assist Police officers conducting enforcement activity:

# When enforcement is taking place in an area where drivers are making the transition from a higher speed to a lower speed area, vehicles should not be targeted within 250 (two hundred and fifty) metres from the point where the speed limit changes unless there are good reasons to do so, such as protecting people operating at road works or to ensure the safety of children. (This does not apply within school zones.)
# When speed camera enforcement is taking place in the area of passing lanes, vehicles should not be targeted within 250 (two hundred and fifty) metres of the finish of any passing lane.

# All speed measuring devices are to be operated in an overt manner. Hidden or camouflaged deployment is not to be used unless there is a specific operation targeting offending consisting of:
# Sustained loss of traction; or
# Engaging in an unauthorised street or drag race; or
# Dangerous or reckless driving.
# The operation cannot effectively or safely be conducted using overt means.
# Such operations must be recorded by way of written operation order and pre-approved in writing by the district road policing manager.


If you can prove (cellphone photo?) the officer was concealed in someway then you may have a chance at defending any ticket at the roadside or letter. Remember whilst you are in correspondence with police over an infingement, you are not required to pay the ticket. The longer you draw out the process with them by correspondence the more likely they will drop the ticket or at least give you more time to come up with the funds.

If you get a ticket you think is dodgy, stop and take note or everything that happened including the surroundings, approximate positions etc, at the time you got the ticket. DONT drive off and come back later if you can help it. The officers details are on the ticket. Show him by surveying the area that your serious about possibly defending the ticket. That'll put the sh*t up him.

I have no issues with a properly enforced offence. I dont like (as do anyone) police who write tickets for minor things to make up numbers. Observe the officers actions before and after. See if you can get him for something. A good one is if he is/isnt wearing his hi-vis. I personally know of a case where a driver was pulled over and the officer was being an ignorant ass and refused to listen to anything. Luckily the passenger was an OSH officer who gave the cop a fine for not wearing his hi-vis on the roadside. Well thats how i heard it.

Taking notes straight away is the best thing you can do. You do not have to drive off away from the scene immediatly. Unless it is unsafe for you to be there inwhich case you shouldnt have been stopped anyway and that would be another point in your defence.

Production of documentation/viewing of the device readouts (excluding speed cameras).

From time to time motorists may request to see a device logbook, certificate of accuracy or device readout at the roadside. These are matters of discretion for the Constable according to the circumstances, which may include the demeanor of the offending driver, potential risks to safety (eg. Motorists walking on the highway) or impracticability (such as speeds detected remotely from the vehicle stop). Staff are reminded, however, that catering for reasonable requests may save unnecessary court appearances or complaints.


ASK TO SEE THE LOGBOOKS FOR THE DEVICE! just another thing they have to prove.
