Used to be, those jokes about the recording industry eventually wanting its cut for every song you idly hum were amusing . Nowadays, not so much . The U . K . 's Performing Rights Society, which collects royalties for songwriters and performers, is suing the Kwik-Fit car repair chain because the mechanics listen to their radios during work at volumes loud enough to be heard by colleagues and customers . ( . bbc . co . uk/1/hi/scotland/edinburgh_and_east/7029892 . stm" target="_blank">news . bbc . co . uk) That, the PRS contends, constitutes a public performance . Kwik-Fit wanted this abomination drop-kicked out of court, but a judge in Edinburgh ruled Friday that it should proceed, saying there was a least a chance the PRS could prevail . In his ruling, Lord Emslie said: "The key point to note, it was said, was that the findings on each occasion were the same with music audibly 'blaring' from employee's radios in such circumstances that the defenders' [Kwik-Fit] local and central management could not have failed to be aware of what was going on . " Kwik-Fit management says it has long had a ban on employees using personal radios, but the PRS said it documented more than 250 occasions since 2005 that its investigators swung by a Kwik-Fit and heard music from the garage . I'd like to make a joke here about future legislation mandating headphone use in all public places, but I'm afraid of becoming a prophet . Me here: I'd like to make a joke too . . . but it's up there ^^ |
