600778 2007-10-12 02:06:00 Rather a large age difference but where do you draw the line?

Not this instance perhaps as we don't know the full story, but in my family it seems to be rather common to have the older/younger partners.

2 of my cousins married older men, one a lot older.
My husband is older.
My sons girlfriend is older.
1 of my cousins married a much younger guy.

Are we all perverts or married to perverts then?
No....they're all in committed relationships, and so are you.

This old man and young woman aren't in any committed relationship, and they shouldn't have been rooting each other given their relationship as a provider and a homestayer.

600779 2007-10-12 02:18:00 The article is in more detail in Stuff. www.stuff.co.nz

Note that the law has changed to 18, whereas it was 20 years of age.

Also note in the article that the prosecutor said: "The impact on the victim was profound and ongoing.

"It was not a case of a man simply giving in to temptation, it was non-consensual."

It was clearly an abusive relationship, whether or not it was consensual. Just imagine if it was your daughter in this situation in an overseas country. You would have expected that the people with whom she was living would have kept her safe, not done this sort of thing.

Personally I am not sure why he wasn't sent to prison.

Read the earlier replies in this thread. The 20/18 years of age limit is for people who are under your care or protection, not your boyfriend or girlfriend.

600782 2007-10-12 02:41:00 Here you go - Crimes Act 1961 (I assume this is the section the b'stard was charged under):

131 Sexual conduct with dependent family member

(1) Every one is liable to imprisonment for a term not exceeding 7 years who has sexual connection with a dependent family member under the age of 18 years.

(2) Every one is liable to imprisonment for a term not exceeding 7 years who attempts to have sexual connection with a dependent family member under the age of 18 years.

(3) Every one is liable to imprisonment for a term not exceeding 3 years who does an indecent act on a dependent family member under the age of 18 years.

(4) The dependent family member cannot be charged as a party to the offence.

(5) It is not a defence to a charge under this section that the dependent family member consented.

131A Dependent family member defined

(1) For the purposes of section 131, one person is a dependent family member of another person---

(snip)

(c) if he or she is living with the other person as a member of the other person's family, and the other person is not a person referred to in paragraph (a), but has---

(i) power or authority over him or her; and

(ii) a responsibility for, or significant role in, his or her care or upbringing.

Section 131A: inserted, on 20 May 2005, by section 7 of the Crimes Amendment Act 2005 (2005 No 41).

Same here. It's also interesting how it took so long for him to be charged. It happened back in 1989-1990.

Who said a line had to be drawn? I see nothing wrong with older/younger relationships providing it is consensual and not illegal. Quite a few members of my extended family are in such relationships. I think in one instance there is 25 years difference between one pair.
