You ignored Trademe rules concerning giving out contact details in an auction. That automatically gives them the right to pull your auction. Didn't you read the rules under which auctions are carried out on Trademe? You deserved all that you got. Learn from it and try again. And don't mention the Scouts as a good reason to break the rules. It ain't. |

As for everything else, I agree with what most people are saying - you break the rules, they have the right to pull your auctions . |

| 610413 | 2007-11-11 09:33:00 | well before i screwed him i asked on the TM message board what others would do, and they all went for getting as much as i could for the scouts. was it my money i would've simply let him have it. no reason for all this to happen, trademe's handling of the matter is what gets me the most. The advice you got from a message board isn't really relevant. It comes down to trademe rules and common law. You should have probably asked trademe direct, or the CAB which is free. Your story is somewhat similar to one on Fair Go, where someone entered into a contract to buy a boat, I think via trademe. The seller decided to pull out of the sale because they were offered a higher price by someone else, even though they had agreed to sell it to this other person. The unsuccessful buyer who tried to buy the boat them took them to the disputes tribunal and won costs against the seller, which amounted to several thousand dollars. The seller then refused to pay, and hid behind their job, hence they were taken to fair go. |

If you wrote a great description and want access to it, go to any auction, go to the 'printer friendly view' and replace the auction number in the URL with your withdrawn one. thanks. for the record, there was never any obligation to sell to that bidder as he never hit buynow. i was perfectly within the rules on that one. my trailer auction had the firewood comment removed and that is fine. the bike auction was listed correctly in my opinion, and they only warned me about my phone number as it was clear i was not making any deals would you buy a wrecked vehicle without viewing? i wouldn't, and by encouraging buyers i am effectivly increasing TMs success fee. i've been caught out on the bike one by a quirk in the rules, in that you can give details in the motor section of trademe, but not in the listing itself. by biggest issue is trademe's dealing with me. they had responded to the bidder's complaint in less than 10 minutes, yet i am still waiting for an email back. atleast if i was able to reply directly to the emails about my auctions being closed this would be easier, but no, i have to go through support. |

Once a trader places a bid (whether or not it is the same as the buynow price) you are obligated to let that auction run; as per TradeMe's rules. Not all traders actually use, or know how to use, Buy Now. I know when I first started, I made a few errors and missed one or 2 things. You seem to be under the illusion you are right because you keep trying to justify your actions. You're not. You got served. Handle it and move on |

| 610418 | 2007-11-11 20:20:00 | Let me get this straight. Buyer bids $XX on your item. $XX is the same as the buynow price. Buyer contacts you to say "Oops, I meant to choose the buynow instead of bidding - can you remove my bid so that I can buynow?" You remove the bid, but decide that the price was too low and remove the buynow as well, seeing an opportunity to suck more dosh from the buyer. Buyer gets (quite rightly) rather annoyed that you have screwed him and complains. Trademe pulls your listing for contravening the TOS. Sounds to me that while you were technically in the right to remove the buynow price, you acted in a very mean-spirited manner. I'm not surprised the buyer complained. And you broke the TOS agreement, so Trademe was quite within its rights to pull your listing. They may have been more lenient if you weren't behaving so badly towards their customers though. In my humble opinion you deserved everything you got. |
